This bill increases the amounts of the 2020 recovery rebate, repeals the immunity from liability of a provider or user of an interactive computer service for screening and blocking offensive content, and addresses the administration of federal elections. The bill increases the amount of the 2020 recovery rebate for individual taxpayers to $2,000 ($4,000 for joint returns). The amount of such rebate is phased out for taxpayers whose adjusted gross income exceeds $75,000 ($150,000 for joint returns). A recovery rebate is a stimulus payment for taxpayers and their dependents who are adversely affected by COVID-19 (i.e., coronavirus disease 2019). This bill also removes the immunity from liability of a provider or user of an interactive computer service (e.g., a social media company) for screening and blocking offensive content on its platform. Regarding the conduct of federal elections, the bill establishes a bipartisan advisory committee within the Election Assistance Commission (EAC) to study the integrity and administration of the November 2020 general election. Under the bill, each chief state election official must disclose to the EAC the identity of any foreign national known by that official to have (1) physically handled either ballots used in an election for federal office or voting machines, (2) had unmonitored access to a storage facility or centralized voting-tabulation location used to support an election, or (3) had unmonitored access to election-related information or communications technology. It also requires the official to make the disclosure within 30 days of becoming aware of such activity.

No Congressional Gun Loophole Act This bill prohibits the Capitol Police Board from allowing Members of Congress or their staff to carry firearms on the grounds of the U.S. Capitol or in its buildings. Members and their staff may store firearms in their cars in Capitol complex garages if their possession complies with the firearms laws of the District of Columbia and the firearms are locked with gun locks while on the complex. Current board regulations allow Members of Congress to keep firearms in their offices; the regulations also allow Members and their staff to transport unloaded and securely wrapped firearms within the Capitol grounds. Firearms are prohibited inside the chambers of the Senate and the House of Representatives, as well as in adjacent lobbies and cloakrooms, the galleries, the Marble Room of the Senate, and the Rayburn Room of the House, unless approved by the Sergeants at Arms for security purposes.

Preventing a Patronage System Act or the PPS Act This bill prohibits executive agency positions in the competitive service from being placed in the excepted service, unless such positions are placed in Schedules A through E as in effect on September 30, 2020. The bill also prohibits positions in the excepted service from being placed in any schedule other than the aforementioned schedules. On October 21, 2020, the President issued an executive order titled Creating Schedule F in the Excepted Service . The order places executive agency positions that are of a confidential, policy-determining, policy-making, or policy-advocating character, and that are not normally subject to change as a result of a presidential transition, under a new schedule in the excepted service (Schedule F) instead of the competitive service. The order also requires any such positions in the excepted service to be reclassified to Schedule F.

This bill provides for additional 2020 recovery rebates (i.e., refundable tax credits) for individual taxpayers whose gross income does not exceed $75,000 ($150,000 for joint return filers). The amount of such rebates are $2,000 for each individual taxpayer ($4,000 for joint return filers) and $600 for each qualifying child of the taxpayer. The Internal Revenue Service may determine eligibility for the recovery rebate based on a taxpayer's 2019 tax return or other information if the taxpayer has not filed a return for 2019. To be eligible for a recovery rebate, a taxpayer must provide a valid identification number (i.e., a Social Security account number). If only one spouse filing a joint return provides a valid identification number, the amount of the recovery rebate is reduced to $2,000. The bill provides a limited exemption from garnishment and other offsets for recovery rebates.

National Emergencies Reform Act This bill revises provisions of the National Emergencies Act relating to the termination of presidentially-declared national emergencies. Specifically, the bill provides that any national emergency declared by the President shall terminate if (1) no joint resolution has been enacted affirming the declaration of such emergency before the expiration of the 48-hour period beginning on the first day after such emergency is declared and on which both houses of Congress are in session, (2) a joint resolution is enacted terminating the emergency, or (3) the President issues a proclamation terminating the emergency. The date on which a presidentially-declared emergency terminates is 60 days after the President transmits to Congress the proclamation declaring the emergency or Congress affirms a previous renewal unless the President publishes in the Federal Register and transmits to Congress an executive order renewing the emergency, and a joint resolution is enacted affirming the renewal of the declaration. A national emergency declared before the enactment of this bill shall be unaffected by the amendments made by this bill except that such emergencies shall terminate 60 days after enactment unless renewed.

Citizen Justice Restoration Act of 2020 This bill prohibits decisions to search, seize, or scrutinize an individual that discriminate on the basis of race, ethnicity, national origin, religion, or sex. Specifically, the bill prohibits a person acting under color of law from basing a decision to search, seize, or scrutinize an individual on actual or perceived race, ethnicity, national origin, religion, or sex, including sexual orientation, and makes evidence obtained as a result of such a search or seizure inadmissible, with exceptions; requires an application for a writ of habeas corpus on behalf of a person in custody pursuant to the judgment of a state court to be granted with respect to any federal claim that was adjudicated on the merits in state court proceedings, which adjudication was in error; makes a new rule of constitutional law announced by the U.S. Supreme Court, a U.S. Court of Appeals, or a U.S. District Court retroactive to cases on collateral review; and requires an ambiguity in a statute that provides protection against discrimination on the basis of race, color, ethnicity, national origin, religion, disability, or sex to be construed in the manner that will provide the greatest protection against such discrimination. The bill further creates a private right of action and provides for the award of a bounty for citizen lawsuits under specified circumstances.

Protect Asylum Seekers Act This bill limits the separation of alien families and provides protections for asylum seekers. Certain civil and criminal penalties related to improper entry into the United States shall not apply if, after entering the United States, an alien without delay communicates to an immigration or asylum officer a non-fraudulent (1) desire to seek asylum, or (2) fear of persecution. The Departments of Homeland Security (DHS), Justice, and Health and Human Services shall not separate a child from a parent or legal guardian unless a state court terminates the parent or legal guardian's rights; a state child welfare agency or court determines it is in the child's best interests to be removed; or the child is determined to be a trafficking victim or at risk of becoming one, the accompanying adult is most likely not the parent or legal guardian, or the child is in danger of abuse or neglect. An agency may not separate a child from a parent or legal guardian solely to deter migration into the United States or to promote compliance with immigration laws. DHS shall develop (1) training related to the bill's family separation requirements, and (2) guidance for how parents and legal guardians may locate a separated child. DHS shall provide parents and legal guardians periodic status updates about a separated child. The Government Accountability Office shall report to Congress on the criminal prosecution of asylum seekers.

Robert Levinson Hostage Recovery and Hostage-Taking Accountability Act This bill establishes various entities and procedures to address the wrongful detainment of U.S. nationals abroad. The President shall appoint a Special Presidential Envoy for Hostage Affairs. The envoy's duties shall include leading diplomatic engagement on U.S. hostage policy and coordinating diplomatic engagements in support of hostage recovery efforts. The President shall establish an interagency Hostage Recovery Fusion Cell, which shall assess and track all hostage cases of U.S. nationals and coordinate agency efforts to safely recover hostages. The President shall also establish the Hostage Recovery Group, which shall make recommendations regarding hostage recovery options and coordinate the development and implementation of U.S. hostage recovery policies. The President is authorized to impose visa- and property-blocking sanctions against any foreign person responsible for or complicit in the unlawful or wrongful detention of a U.S. national abroad. The Department of State shall review cases where U.S. nationals are detained abroad and refer instances of wrongful or unlawful detainment to the Special Presidential Envoy for Hostage Affairs.

Vet Center Improvement Act of 2020 This bill requires the Department of Veterans Affairs (VA) to evaluate productivity expectations for readjustment counselors of Vet Centers, including by obtaining feedback from counselors that must be audited annually for five years by the Government Accountability Office. The VA must also (1) develop and implement a staffing model for Vet Centers, (2) standardize descriptions of position responsibilities at Vet Centers, and (3) award grants to address food insecurity among veterans and family members of veterans who receive services through Vet Centers or other VA facilities.

Intelligence Community Congressional Whistleblowing Improvement Act This bill expands protections for whistleblowers who are employed by a covered agency in the intelligence community (or by a contractor of such an agency) to apply to protected disclosures made to any Member of Congress. Currently, when a protected disclosure is made to Congress, whistleblower protections generally apply only if the disclosure was made to a congressional intelligence committee or to a member of such a committee.
