Inaugural Fund Integrity Act This bill imposes various restrictions on presidential inaugural committees, including prohibitions on soliciting or accepting donations from foreign nationals or from entities that are not individuals. The bill also forbids an individual from donating more than $50,000 to such a committee.

Shutdown Prioritization Act or the SPA Act This bill prohibits operation of an exercise facility for Members of the House of Representatives or the Members' Dining Room in the U.S. Capitol during a government shutdown. After the shutdown ends, furloughed employees of such facility or dining room must be compensated at their standard salary for the period of the shutdown.

DIVISION A--FURTHER ADDITIONAL CONTINUING APPROPRIATIONS ACT, 2019 Further Additional Continuing Appropriations Act, 2019 (Sec. 101) This division amends the Continuing Appropriations Act, 2019 to provide continuing FY2019 appropriations to several federal agencies through the earlier of February 8, 2019 (December 21, 2018, under current law), or the enactment of the applicable appropriations legislation. It is known as a continuing resolution (CR) and ends the partial government shutdown that began when the existing CR expired because seven of the remaining FY2019 appropriations bills have not been enacted. (Five of the FY2019 appropriations bills were enacted earlier this year, including: the Department of Defense Appropriations Act, 2019; the Energy and Water Development and Related Agencies Appropriations Act, 2019; the Departments of Labor, Health and Human Services, and Education, and Related Agencies Appropriations Act, 2019; the Legislative Branch Appropriations Act, 2019; and the Military Construction, Veterans Affairs, and Related Agencies Appropriations Act, 2019.) The CR extends through February 8, 2019: the Department of Homeland Security Chemical Facility Anti-Terrorism Standards Program; the authority for the Department of Health and Human Services Biomedical Advanced Research and Development Authority to withhold from public disclosure certain technical data or scientific information that reveals vulnerabilities of existing medical or public health defenses against biological, chemical, nuclear, or radiological threats; and an exemption from antitrust laws for meetings and consultations to discuss the development of certain vaccines and drugs related to public health threats such as bioterrorism, pandemics, or epidemics. Additionally, the CR has the effect of extending through February 8, 2019, several authorities and programs that were extended in prior CRs, including: the National Flood Insurance Program, the Violence Against Women Act, the authority for the Environmental Protection Agency to collect and spend certain fees related to pesticides, the Temporary Assistance for Needy Families (TANF) program, and several authorities related to immigration. The CR also delays the release of required Congressional Budget Office and Office of Management and Budget sequestration reports. DIVISION B--MEDICAID EXTENDERS (Sec. 101) The division amends the Deficit Reduction Act of 2005 to make appropriations for FY2019, and otherwise revise, the Money Follows the Person Rebalancing Demonstration Program (Under this program, the Centers for Medicare & Medicaid Services must award grants to state Medicaid programs to assist states in increasing the use of home and community care for long-term care and decreasing the use of institutional care.) (Sec. 102) Additionally, the division temporarily extends the applicability of Medicaid eligibility criteria that protect against spousal impoverishment for recipients of home and community-based services. (Sec. 103) The division also reduces the federal medical assistance percentage (i.e., federal matching rate) for states that have not implemented asset-verification programs for determining Medicaid eligibility. (Sec. 104) The division reduces funding available to the Medicaid Improvement Fund beginning in FY2021. (Sec. 105) This section exempts the budgetary effects of this division from: (1) the Pay-As-You-Go (PAYGO) rules established by the Statutory Pay-As-You-Go Act of 2010 and the FY2018 congressional budget resolution, and (2) certain budget scorekeeping guidelines. It also requires any debits on the statutory PAYGO scorecard for 2019 to be transferred to the 2020 scorecard. (The Statutory Pay-As-You-Go Act of 2010 prohibits certain legislation from increasing the budget deficit. PAYGO scorecards are used to enforce the requirements and determine whether a sequestration order implementing spending cuts is necessary.)

This bill prohibits the Department of Health and Human Services from blocking any program administered by the Centers for Medicare & Medicaid Services or the Indian Health Service that reimburses medical providers for the use of unmanned aerial systems that deliver medical supplies. Additionally, the Federal Aviation Administration may not prohibit the operation of such systems beyond the line of sight.

Border Security and Child Safety Act This bill requires the Department of Homeland Security to present to Congress a strategy to ensure the safety of children in the custody of U.S. Customs and Border Protection or U.S. Immigration and Customs Enforcement, and to prioritize hiring medical personnel to handle the care of such children.

Telephone Robocall Abuse Criminal Enforcement and Deterrence Act or the TRACED Act This bill implements a forfeiture penalty for intentional violations of the prohibition on certain robocalls. The bill also limits the scope of an annual reporting requirement for enforcement relating to unsolicited facsimile advertisements. The bill requires voice service providers to develop call authentication technologies. The Federal Communications Commission (FCC) shall promulgate rules establishing when a provider may block a voice call based on information provided by the call authentication framework, but also must establish a process to permit a calling party adversely affected by the framework to verify the authenticity of their calls. The FCC shall also initiate a rulemaking to help protect a subscriber from receiving unwanted calls or texts from a caller using an unauthenticated number. This bill requires the Department of Justice to assemble an interagency working group to study and report to Congress on the enforcement of the prohibition of certain robocalls. Specifically, the working group will look into how to better enforce against robocalls by examining issues like the types of laws, policies, or constraints that could be inhibiting enforcement. The bill requires the FCC to initiate a proceeding to determine whether its policies regarding access to number resources could be modified to help reduce access to numbers by potential robocall violators.

National Flood Insurance Program Competition and Extension Act of 2018 This bill amends the National Flood Insurance Act of 1968 to reauthorize the National Flood Insurance Program through May 31, 2019. The bill shall take effect as if it had been enacted on December 21, 2018. The Federal Emergency Management Agency (FEMA) must allow a Write Your Own company to sell private flood insurance. (A Write Your Own company writes and services federal standard flood insurance policies in its own name.)

Disaster Housing Assistance Program Accountability Act This bill requires the Federal Emergency Management Agency (FEMA) to establish at least three pilot programs to provide long-term rental-housing assistance and case-management services to families affected by a major disaster in either a U.S. territory in 2017 or a state in 2018.

Automated Mobility Act of 2018 This bill establishes within the Department of Transportation (DOT) the position of Assistant Secretary of Automated Mobility with duties that include coordinating federal agency efforts to test and deploy automated vehicles. DOT shall submit to Congress a five-year plan to, among other things: (1) adapt federal vehicle safety standards and infrastructure to accommodate automated vehicles; (2) evaluate the readiness of the federal interstate highway system to accommodate automated vehicles; (3) establish a framework for automated vehicle safety assurance; (4) develop uniform standards for, and procedures to test, automated vehicles and automated driving software; and (5) adapt existing safety oversight authority and enforcement capabilities to accommodate automated vehicles.

Crooked River Ranch Fire Protection Act This bill: (1) modifies the boundary of the Deschutes Canyon-Steelhead Falls Wilderness Study Area in Oregon to exclude approximately 688 acres of public land; and (2) directs the Department of the Interior to manage such land to improve fire resiliency and forest health, including the conduct of wildfire prevention and response activities.

Faster Access to Federal Student Aid Act of 2018 This bill requires the Internal Revenue Service (IRS) to disclose certain tax return information to the Department of Education (ED) for the purpose of administering financial aid and loan programs under the Higher Education Act of 1965. (Under current law, students must obtain their own tax return information from the IRS and submit it to ED.) Upon receiving a request from ED, the IRS must disclose specified tax return information to ED for the purposes of establishing, renewing, administering, and conducting analyses and forecasts for estimating costs related to income-contingent or income-based repayment programs; the discharge of loans based on a total and permanent disability; determining the eligibility for, and the amount of, federal student financial aid; and conducting analyses and forecasts for estimating costs related to federal student financial aid programs. ED may only use the disclosed information for the purposes above and for mitigating risks related to the programs. Mitigating risks includes activities related to analyzing or estimating costs, conducting oversight, developing statistics, and reducing improper payments. It does not include conducting criminal investigations or prosecutions. With the consent of the taxpayer, ED may disclose the return information to certain institutions of higher education, state higher education agencies, and scholarship organizations solely for the use in financial aid programs. The bill also specifies notification and reporting requirements related to the disclosures and the implementation of this bill.

Uighur Intervention and Global Humanitarian Unified Response Act of 2018 or the UIGHUR Act of 2018 This bill restricts executive agencies from procuring goods and services from foreign persons involved in China's mass detention of the Uyghurs, a predominantly Muslim Turkic ethnic group in Xinjiang province. It also places export controls on various technologies used to facilitate the mass detentions.

American Agriculture First Act This bill requires the Agricultural Marketing Service (AMS) to purchase at least 75% of the agricultural commodities of the Food Purchase and Distribution Program from domestically owned enterprises if it is necessary to respond to trade damage from retaliation by foreign nations with respect to agricultural commodities. The requirement does not apply if the Department of Agriculture reports to Congress that meeting the requirement is not possible because the agricultural commodities available from domestically owned enterprises cannot meet the supply needs of the AMS; or would result in a greater than 150% increase between (1) the amount necessary to purchase the agricultural commodities, and (2) the average cost of the agricultural commodities purchased by the AMS in the prior 3 years. The authority provided by this bill expires on September 30, 2023.

Children of Fallen Servicemembers AMT Relief Act This bill amends the Internal Revenue Code, with respect to the individual alternative minimum tax (AMT), to specify that any annuity paid under the Department of Defense (DOD) Survivor Benefit Plan is considered earned income of a child. This prevents the benefits paid to children from being subject to the AMT. (The DOD program provides a lifetime annuity to survivors of military service members and retirees.)

Stronger, Healthier Environment for Low-Income Tenants and Economic Renewal Act of 2018 or the SHELTER Act of 2018 This bill limits or repeals several tax deductions, credits, and related rules that benefit major integrated oil companies. It also repeals royalty relief (suspension of royalties) for (1) natural gas production from deep wells in shallow waters of the Gulf of Mexico, and (2) deep water oil and gas production in the Western and Central Planning Area of the Gulf (including a specified portion of the Eastern Planning Area). Any increase in revenues as a result of this bill must be credited to the Housing Trust Fund, which provides funding to states for activities to increase affordable housing. The bill also specifies requirements for the fund regarding funding for (1) environmental rehabilitation activities, and (2) childhood lead prevention.

Minimum Wage Fairness Act of 2018 This bill requires the Department of Labor to identify each fiscal year any states that have reduced their minimum wage or that have reduced a minimum wage increase that would otherwise become effective. Labor must then notify federal agencies that administer programs in such states and such agencies must reduce the funding for the administrative costs of such programs by a percentage equivalent to the reduction in the minimum wage in such states.

Protect SNAP Act This bill prohibits the Department of Agriculture from modifying certain regulations for the Supplemental Nutrition Assistance Program (SNAP, formerly known as the food stamp program) regarding the time limit for able-bodied adults, work requirements, and waivers of the requirements.

DEA Notification Act of 2018 This bill requires the Centers for Medicare & Medicaid Services to notify the Drug Enforcement Administration (DEA) of providers or suppliers that are prohibited from participating in Medicare due to improper prescriptions of controlled substances, and to recommend that the DEA consider revoking certain controlled substance registrations or waivers held by such providers or suppliers.

Federal Employee Retroactive Pay Fairness Act This bill requires federal employees furloughed due to a lapse in appropriations that begins on or about December 22, 2018, to be compensated at their standard rate of compensation for the period of such lapse as soon as practicable after such lapse ends.

Revitalizing Amendment Motions for Patents Act of 2018 or the RAMP Act This bill establishes that for motions to amend patent claims challenged at the Patent Trial and Appeal Board (PTAB), a patent examiner shall prepare an advisory report about the patentability of the proposed amended claims, which the PTAB shall consider when deciding the motion. The proposed amended claims shall be construed under the broadest reasonable interpretation standard for the purposes of the motion.

Biased Algorithm Deterrence Act of 2018 This bill provides that an owner or operator of a social media service shall be treated as a publisher or speaker of user-generated content (and, therefore, may potentially be held liable with respect to such content) if the service or its algorithm does any of the following: displays user-generated content in an order that is not chronological; delays the display of such content relative to other content; or hinders the display of such content for reasons other than to carry out the user's direction or to restrict material that the provider or user considers obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable.

Pay our Doctors Act of 2018 This bill provides FY2019 appropriations to the Indian Health Service (IHS) if a joint resolution making continuing appropriations for FY2019 is not in effect. In the event of a partial government shutdown due to a lapse in appropriations, the bill provides continuing appropriations to the IHS at the same level that was provided for FY2018.

Voter Information and Access Act of 2018 This bill expands the uses of certain Department of Justice (DOJ) grant funds to include voting restoration and voter registration education for persons in prisons, jails, and juvenile facilities. DOJ is authorized to make grants to states and units of local government to: (1) install polling places in jails for use by detained persons eligible to vote; (2) provide absentee ballots to detained persons eligible to vote; and (3) provide counseling, education, and information services on voting restoration and voter registration in prisons.

Token Taxonomy Act This bill specifies that digital tokens, such as those used in virtual currencies, are not securities for regulatory purposes. The bill also provides for the tax treatment of virtual currencies, including by excluding from gross income any gains from virtual currency transactions up to $600.

Emery County Public Land Management Act of 2018 This bill establishes the San Rafael Swell Recreation Area in Utah. The Department of the Interior shall study nonmotorized recreation opportunities, including bicycle trails, within the recreation area. The bill: (1) designates specified federal lands in Utah managed by the Bureau of Land Management (BLM), including the San Rafael Reef, as components of the National Wilderness Preservation System; (2) designates a 63-mile segment of Green River as a component of the national wild and scenic rivers system; (3) allows the grazing of livestock, if already established, to continue in the newly established recreation area and wilderness areas; and (4) allows for commercial services necessary to fulfill recreational purposes. Interior shall establish a trail plan that addresses hiking and equestrian trails in the wilderness areas. In addition, with respect to other land in Utah, the bill provides for the management of the Goblin Valley State Park Expansion as a state park; the establishment of the Jurassic National Monument; the sale of public lands in Emery County which have been identified as suitable for disposal; public purpose conveyances of Emery City Recreation Area, the Huntington Airport, Emery County Sheriff's Office substation, and the Buckhorn Information Center; and the exchange of BLM and School and Institutional Trust Lands Administration lands in Utah.

Effective Apprenticeships to Rebuild National Skills Act or the EARNS Act This bill (1) establishes in the Department of Labor an Office of Apprenticeship and a National Advisory Committee on Apprenticeships, (2) provides for federal recognition of state apprenticeship agencies, (3) establishes a process and standards for the national apprenticeship system, (4) directs Labor to provide for evaluations of programs and activities and research on best practices in covered apprenticeship programs, and (5) sets up a grant program to modernize and expand apprenticeship programs.

End Palestinian Terror Salaries Act of 2018 This bill directs the President to impose sanctions on entities affiliated with the Palestinian Authority or the Palestine Liberation Organization that authorize compensation payments to terrorists in Israeli prisons or to the families of deceased terrorists.
