Blocked Rail Crossings Safety Improvement Act of 2021 This bill addresses safety and congestion along railroad right-of-way and highway-rail grade crossings. For example, the bill directs the Department of Transportation (DOT) to provide grants to (1) assist state, local, and tribal governments in funding the cost of highway-rail grade crossing separation projects; and (2) help nonprofit organizations carry out public information and education programs to help prevent and reduce rail-related pedestrian, motor vehicle, and other incidents, injuries, and fatalities, and to improve awareness along railroad right-of-way and at highway-rail grade crossings. Additionally, the bill prohibits railroad carriers from obstructing travel at public highway-rail crossings for more than 10 minutes, except under limited circumstances (e.g., safety issues). Further, DOT must (1) establish a national blocked crossings database for the public to report blocked crossing incidents; (2) conduct a comprehensive review of the national highway-rail crossing inventory; and (3) revise its regulations, guidance, or other relevant agency documents to include the number of suicides on a railroad crossing or railroad right-of-way in the total number of rail fatalities it reports each year.

The amendment also requires a cancellation of budget authority that is equal to the amount by which total outlays exceeded these limits during the preceding fiscal year. The amendment requires a three-fourths roll call vote of each chamber of Congress to increase the public debt limit or increase revenue. The amendment also requires the President to submit an annual budget in which total outlays do not exceed total receipts. Congress may waive these requirements due to a declaration of war or a military conflict that causes an imminent and serious military threat to national security.

Earth Act of 2022

Earth Act of 2022 This bill addresses climate change by establishing requirements concerning renewable energy, zero emission vehicles, regenerative agriculture, and tax incentives related to climate transition costs. Specifically, the bill requires that by 2030, 100% of electricity sold by certain retail electric suppliers must be from renewable energy resources (e.g., wind energy); new motor vehicles (e.g., certain cars and trucks) sold by manufacturers must be zero emission vehicles; land and livestock managed by certain publicly-traded corporations must be managed with regenerative agricultural practices. The Department of Energy (DOE), the Department of Transportation, and the Department of Agriculture (USDA) must create grants to pay up to 50% of the costs of meeting those requirements. DOE must also issue regulations regarding the sourcing, recycling, and disposal of materials used to manufacture renewable energy sources (e.g., equipment that stores renewable energy). The goals of the regulations must be to (1) eliminate the use of rare earth metals in the manufacture of those sources, and (2) ensure the recycling of all such materials. USDA must issue regulations that (1) require the reduction of greenhouse gas emissions resulting from certain land or livestock corporations, and (2) ensure the well-being of animals raised for human consumption or the production of dairy products. The bill also provides tax incentives for electric suppliers, vehicle manufacturers, and such corporations to meet the requirements established by this bill by allowing them to double certain tax deductions for qualified capital climate transitions costs.

Farmers Feeding Families Act of 2022 This bill amends The Emergency Food Assistance Program (TEFAP) to authorize the Food and Nutrition Service (FNS) to provide funds for states to purchase priority agricultural products (e.g., fruits, vegetables, meats, and grains) from eligible small businesses and distribute them to needy persons through emergency feeding organizations. New farmers and small or mid-sized family farms qualify as eligible small businesses under this FNS program, as well as packers, distributors, cooperatives, and others that source agricultural products from them. The bill also requires a state's TEFAP plan eligibility standards to include, at a minimum, all individuals or households with an income less than 250% of the poverty line.

Medical Innovation Act of 2022 This bill requires certain drug manufacturers to make payments to fund research supported by the Food and Drug Administration (FDA) and the National Institutes of Health (NIH). A drug manufacturer with over $1 billion in net income in a fiscal year that has entered into a relevant settlement agreement regarding specified violations must pay 0.75%-1.5% of its net income to the Department of Health and Human Services for each of its covered blockbuster drugs. A covered blockbuster drug is a drug that has at least $1 billion in net sales in a year and was developed, in whole or in part, through federal investments in medical research. Payments are divided between the FDA and the NIH in proportion to the discretionary funding of those agencies, excluding FDA user fees. Payments are not disbursed if appropriations for the FDA or the NIH are lower than in the prior fiscal year. Priorities for payments must include advancing regulatory science for medical products and research related to diseases that disproportionately account for federal health care spending. A covered blockbuster drug for which a manufacturer has not made a required payment is considered misbranded and subject to prohibitions on introducing or receiving misbranded drugs in interstate commerce.

The Centers for Disease Control and Prevention may expand infrastructure and activities to track the epidemiology of up to four rare diseases and conditions and incorporate this information into a National Rare Disease or Condition Surveillance System. The Agency for Healthcare Research and Quality must expand its activities to increase health care providers' awareness of rare diseases and conditions. The National Academies of Sciences, Engineering, and Medicine, or another appropriate entity, must update the 2010 report Rare Diseases and Orphan Products: Accelerating Research and Development.

Next, the bill requires each state to provide for the minimum required number of voting systems, poll workers, and other election resources for each polling location on the day of any federal election and each day of early voting. The Department of Justice must issue uniform standards regarding the minimum number and distribution of such systems, workers, and other resources. The bill also prohibits a chief state election administration official from taking an active part in political management or in a political campaign with respect to any federal election over which the official has supervisory authority, with certain exceptions.

Kansas Indian Country Law Enforcement Improvement Act of 2022 This bill revises Kansas's criminal jurisdiction over offenses committed on the reservation of a covered Indian tribe. Covered Indian tribe means the Iowa Tribe of Kansas and Nebraska, the Kickapoo Tribe of Indians of the Kickapoo Reservation in Kansas, the Prairie Band Potawatomi Nation, and the Sac & Fox Nation of Missouri in Kansas and Nebraska. Specifically, the bill requires affirmative consent from the governing body of a covered tribe for Kansas to have criminal jurisdiction over offenses committed on the tribe's reservation. The bill authorizes federal agencies and state and local governments in Kansas to enter into cooperative agreements or compacts with the governing bodies of covered Indian tribes for specified purposes, such as reducing crime in Indian country and nearby communities. Each cooperative agreement or compact entered into under the bill must (1) authorize law enforcement officers to be deputized, (2) include requirements for reporting crimes, and (3) describe the geographic limits within the reservation and categories of criminal offenses over which Kansas may exercise its jurisdiction. The Department of Justice must, upon request from the governing body of a covered Indian tribe, provide technical assistance in developing cooperative agreements or compacts.

Byrd Mine Safety Protection Act of 2022 This bill revises requirements governing (1) investigations of mine accidents, (2) miners' rights and protections (e.g., whistle-blower rights and protections), (3) mine health and safety standards, (4) underground coal mines, and (5) health and safety training for miners. The Department of Labor, when investigating coal or other mines, must (1) determine why an accident occurred and whether there were violations of law, mandatory health and safety standards, or other requirements; and (2) make recommendations to avoid a recurrence of an accident. The bill expands Labor's enforcement authority, including by requiring Labor to (1) revoke the approval of mine operators' plans or programs based on certain criteria, and (2) order mine operators to withdraw all persons from a mine until Labor approves a new plan. The bill revises civil and criminal penalties, including by subjecting a mine operator who knowingly violates health or safety standards to a felony punishable by up to five years in prison and a $1 million fine. Underground coal mine operators must implement a communication program to brief miners of current mine conditions and install atmospheric monitoring systems. The bill amends the Occupational Safety and Health Act of 1970 to expand its coverage to government employees and increase civil and criminal penalties for violations of the act. The bill also expands whistle-blower rights and protections against retaliation under the act, establishes employee rights with respect to work-related bodily injuries or death, and establishes procedures for correcting serious, willful, or repeated violations of occupational safety and health standards.

Healthy Climate and Family Security Act of 2022 This bill addresses the reduction of greenhouse gas emissions by establishing a program that caps the emissions of carbon dioxide and auctions carbon permits to producers or importers of crude oil, domestic or foreign coal operations, or certain natural gas entities. The bill also establishes the Healthy Climate Trust Fund for the proceeds of the auctions to be distributed as dividend payments to U.S. individuals.
