Constitutional Amendment - Provides that whenever the right to choose the President devolves upon the House of Representatives, the Members of the House shall cast votes on an individual basis, and the candidate receiving the greatest number of votes cast by the Members shall be the President so long as such number is a majority of the votes cast.

Health Care Relief Act of 2004 - Amends the Internal Revenue Code to allow: (1) taxpayers, including non-itemizing taxpayers, a tax deduction from gross income for the first $2,000 of their out-of-pocket medical expenses; (2) certain small business employers a business tax credit for amounts paid for employee health insurance coverage; and (3) a refundable tax credit up to $500 for the health insurance costs of a taxpayer and the taxpayer's spouse and dependents.

Coordinated Environmental Health Network Act of 2004 - Amends the Public Health Service Act to require the Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention (CDC), to establish and operate the Coordinated Environmental Health Network (the Network), including by: (1) identifying, expanding, and coordinating among existing Federal public health and environmental infrastructure; (2) providing for public access to an electronic national database on the incidence and prevalence of specified priority chronic conditions and relevant environmental and other factors; (3) operating a National Environmental Health Rapid Response Service to develop strategies to rapidly respond to, and conduct investigations of, higher than expected incidence and prevalence rates of priority chronic conditions and environmental exposures; (4) awarding grants to States, local governments, territories, and Indian tribes to establish, maintain, and operate State Environmental Health Networks; (5) developing minimum standards and procedures for data collection and reporting for State Networks, including mechanisms for allowing States to set priorities and allocate resources accordingly; (6) establishing an Advisory Committee for the Network; (7) awarding John H. Chafee Public Health Scholarships to eligible students who are enrolled in an accredited school of public health or medicine; and (8) entering into a cooperative agreement with the Council of State and Territorial Epidemiologists to train and place applied epidemiology fellows in State and local health departments. Allows the Secretary to award grants to accredited schools or programs of public health to establish, maintain, and operate Centers of Excellence for research and demonstration with respect to chronic conditions and relevant environmental factors, which may include investigating causal connections between chronic conditions and environmental factors.

Crosby-Puller Combat Wounds Compensation Act - Continues hazardous duty pay, aviation career incentive pay, career enlisted flier incentive pay, hardship duty pay, imminent danger pay, the travel or transportation per diem for duty outside the United States or in Hawaii or Alaska, and the family separation allowance for members of the Armed Forces who are wounded or injured in combat zones and removed from the area for treatment until such time as the member: (1) is found physically fit to perform the duties of the member's office, grade, rank, or rating; (2) is discharged or separated; or (3) dies. Amends the Internal Revenue Code of 1986 to repeal the time limitation on the income tax exclusion for combat zone compensation resulting from hospitalization due to wounds, disease, or injury incurred in such combat zone.

Federal Employees Dental and Vision Benefits Enhancement Act of 2004 - Sets forth provisions for the establishment of programs through which current and retired Federal employees and their family members and dependents may obtain enhanced dental and vision benefits to supplement those available under the Federal Employees Health Benefits Program (FEHB). Urges Congress to evaluate such supplemental plans to determine the options for, and feasibility of, providing an employer contribution. Directs the Office of Personnel Management (OPM) to report to Congress on options: (1) for extending health insurance coverage under FEHB to unmarried dependent college students under age 25; and (2) for extending hearing benefits to Federal employees and annuitants, their relatives, and other appropriate classes of individuals.

Requires the Secretary of Transportation to prohibit any commercial or private aircraft from flying below 18,000 feet within a ten-mile radius of a commercial nuclear power reactor licensed by the Nuclear Regulatory Commission if the threat alert level determined by the Homeland Security Advisory System is elevated to code orange or code red.

Guaranteeing Airport Physical Screening Standards Act of 2004 - Amends Federal transportation law to set a deadline of 120 days after enactment of this Act for the Under Secretary for Border and Transportation Security of the Department of Homeland Security to require screening or inspection of all individuals, goods, property, vehicles, and other equipment before entry into a secured area of a U.S. airport. Requires such screening requirements to include at a minimum physical screening for metal objects. Directs the Secretary of Homeland Security to require random screenings and inspections until such deadline. Authorizes the Secretary to hire additional passenger and baggage screeners to ensure aviation security.

Requires automobile dealers to disclose to consumers the presence of Event Data Recorders (EDRs) on new automobiles at the time of purchase in a clear and conspicuous format that communicates: (1) the presence and location of the EDR; (2) the type of information recorded by the EDR and how such information is recorded; and (3) that information recorded by the EDR also may be used in law enforcement proceedings. Requires automobile manufacturers to include the same information in the owner's manual of any new automobile containing an EDR. Prohibits persons from manufacturing for sale, selling, offering for sale, introducing or delivering into interstate commerce, or importing automobiles manufactured after 2006 (and bearing a model year of 2007 or later) that are equipped with EDRs, unless those EDRs can be disabled by the consumer. Treats a violation of EDR requirements of this Act as an unfair or deceptive act or practice under the Federal Trade Commission Act (FTCA) and requires the Federal Trade Commission (FTC) to enforce this Act accordingly. Requires the National Highway Traffic Safety Administration to study and report to Congress on the potential utility and still unknown consequences of implementing EDR technology.

Servicemembers' Flexible Educational Assistance Act - Allows members of the Armed Forces and Selected Reserve who are entitled to educational assistance under the Montgomery GI Bill to transfer a portion of their entitlement to their dependents. States that a child's use of such transferred entitlement may not commence until the child completes secondary school or attains 18 years of age. Extends the time period for use of such transferred entitlements. Requires the Secretary of Defense to: (1) submit annual reports to specified congressional committees on the number of individuals transferring their entitlement to educational assistance under this Act; and (2) include such information pertaining to the Selected Reserve in biennial reports to Congress. Allows service members and their dependents to choose the program of education for which educational assistance will be used. Redefines the qualifying period of active duty service for members of the Selected Reserve to receive educational assistance as a cumulative period of at least 24 months during any six-year period.

Requires the Director of the National Science Foundation to establish a program to award competitive grants, in coordination with the Secretary of Education, to institutions of higher education (IHEs) for increased education and job training of U.S. nationals who are undergraduate or graduate students in mathematics, science, engineering, and technology. Requires such grants to be provided to IHE applicants that demonstrate they will institute creative and innovative methods of encouraging students to study and enter into careers focused on those disciplines. Requires IHE applications to include: (1) financial incentives to students; (2) commitment to expose students to different industries; and (3) commitment to increase the number of traditionally underrepresented students in those disciplines. Allows IHE recipients to use grant funds: (1) for major research equipment, facilities construction, repair and upgrades, textbooks, and other purposes necessary to create a quality academic program in one or more of those disciplines; and (2) to create interdisciplinary programs in those disciplines to better meet rapidly changing needs in emerging fields.

Disabled Federal Employees Protection Act - Prohibits the termination of employment of a disabled Federal employee due to a conversion to contractor performance of any activity or function of an executive agency under Office of Management and Budget Circular A-76 or any other Federal policy, directive, or regulation. Exempts certain nonprofit agencies for the blind or severely handicapped from this prohibition if the terminated Federal employee is offered an equivalent position in the Federal Government or with the nonprofit agency.

American Indian Veterans Pay Restoration Act of 2004 - Directs the Secretary concerned to pay to each person who is a qualifying Indian veteran an amount equal to the amount of that person's basic pay withheld as State income tax for periods of time during which that person was in active service and domiciled in Indian country.

Mailing Support to Troops Act of 2004 - Authorizes free mailing privileges for mail matter sent by a family member from within an area served by a U.S. post office to members of the Armed Forces on active duty in Iraq or Afghanistan, or hospitalized at an Armed Forces facility as a result of such service.

Amends the Internal Revenue Code to allow a tax credit for up to 20 percent of the basis of qualified woody biomass energy property placed in service in any taxable year. Defines "qualified woody biomass energy property" as new property which is used to produce electricity from woody biomass (e.g., trees and woody plant debris) placed in service before January 1, 2010, and which has a useful life of not less than five years.

Let Parents Raise Their Kids Act of 2004 - Prohibits Federal funds from being used to establish or implement any universal or mandatory mental health screening program. Prohibits Federal education funds from being used to pay any local educational agency or other instrument of government that uses the refusal of a parent or legal guardian to provide consent to mental health screening as the basis of a charge of child abuse or education neglect until the agency or instrument demonstrates that it is no longer using such refusal as a basis of such charge. Defines universal or mandatory mental health screening as any mental health screening program in which a set of individuals is automatically screened without regard to whether there was a prior indication of a need for mental health treatment, including: (1) any program of State incentive grants to implement recommendations in the July 2003 report of the President's New Freedom Commission on Mental Health; and (2) any student mental health screening program that allows mental health screening of individuals under 18 years of age without the express, written, voluntary, informed consent of the parent or legal guardian of the individual involved.

Amends title II (Old Age, Survivors and Disability Insurance) of the Social Security Act to prohibit the receipts and disbursements of the Federal Old-Age and Survivors Insurance Trust Fund and the Federal Disability Insurance Trust Fund (Social Security trust funds) from being included in the Federal budget baseline for any fiscal year and from being counted as new budget authority, outlays, receipts, or deficit or surplus for purposes of offsetting any tax decrease or spending increase. Excludes Social Security trust fund receipts and disbursements totals from official Office of Management and Budget and Congressional Budget Office budget pronouncements.

Telephone Tax Relief for Seniors Act - Amends the Internal Revenue Code to exempt certified low-income senior citizens from communications excise taxes. Prohibits telecommunications carriers from requiring the payment of universal service fees, subscriber line charges, or local number portability charges by such senior citizens who subscribe to telephone services.

Emergency Supplemental Appropriations for Hurricane Disasters Assistance Act, 2005 - Makes FY 2005 emergency supplemental appropriations for additional natural disaster assistance to: (1) the Department of Agriculture for the Emergency Conservation Program of the Farm Service Agency, the Emergency Watershed Protection Program of the Natural Resources Conservation Service, the Rural Community Advancement Program, the Rural Housing Insurance Fund Program Account, and Rural Housing Assistance Grants; (2) the Department of Justice for the Federal Prison System for salaries, expenses, buildings, and facilities; (3) the Department of Commerce for the National Oceanic and Atmospheric Administration for operations, research, facilities, procurement, acquisition, and construction; (4) the Small Business Administration for the Disaster Loans Program Account; (5) the Department of Defense for operation and maintenance (including transfer of funds in some cases) for the Army, Navy, Marine Corps, Air Force, Defense-Wide, Army Reserve, Navy Reserve, Air Force Reserve, Army National Guard, Air National Guard, "Other Procurement, Air Force, "Procurement, Defense-Wide," Defense Working Capital Funds, and the Defense Health Program; (6) the Corps of Engineers - Civil for "General Investigations" and "Construction, General," "Flood Control, Mississippi River and Tributaries, Arkansas, Illinois, Kentucky, Louisiana, Mississippi, Missouri, and Tennessee," "Operation and Maintenance, General," and "Flood Control and Coastal Emergencies;" (7) the U.S. Agency for International Development for International Disaster and Family Assistance; (8) the Department of Homeland Security for the U.S. Coast Guard for Operating Expenses and Emergency Preparedness and Response for Disaster Relief; (9) the Department of the Interior for the U.S. Fish and Wildlife Service and the National Park Service for construction, and the U.S. Geological Survey for surveys, investigations, and research; (10) the Department of Agriculture for the Forest Service for State and private forestry, the National Forest System, wildlife fire management, and capital improvement and maintenance; (11) the Department of Health and Human Services for the Public Health and Social Services Emergency Fund; (12) the Department of Defense for military construction for the Navy, Marine Corps, and Army Reserve, through FY 2007, family housing operation and maintenance of the Army, Navy, Marine Corps, and Air Force, and for the Base Realignment and Closure Account; (13) the Department of Transportation for the Federal Aviation Administration for facilities and equipment, Grants-in-Aid for Airports, the Federal Highway Administration for the Emergency Relief Program (including rescission of contract authorization); (14) the Executive Office of the President for unanticipated needs of the American Red Cross; (15) the Department of Veterans Affairs for the Veterans Health Administration for medical services, administration and facilities, general operating expenses, the National Cemetery Administration, construction, and minor projects; (16) the Department of Housing and Urban Development for the Community Development Fund; and (17) the National Aeronautics and Space Administration for space flight capabilities.

Directs the Secretary of Agriculture to provide emergency financial assistance to agricultural producers who have incurred qualifying 2003 or 2004 crop losses due to weather or related conditions. Permits producers with qualifying losses in both years to elect to receive payments in either, but not both, of such years. Makes producers ineligible for crop disaster assistance if they did not: (1) get Federal crop insurance for insurable commodities; and (2) file required paperwork and pay related fees for noninsurable commodities. Sets forth: (1) waiver provisions; and (2) payment limitations, including reductions for amounts received under the Florida Disaster Programs. Directs the Secretary to provide payments to livestock producers who have incurred 2003 or 2004 losses in an emergency-designated county, with discretionary set-asides for the American Indian livestock program. Permits producers with qualifying losses in both years to elect to receive payments in either, but not both, of such years. Directs the Secretary to provide assistance to commercial orchardists and tree farmers who have suffered losses during the December 1, 2003 through December 31, 2004 period. Directs the Secretary to provide assistance to emergency conservation program participants. Amends the Food Security Act of 1985 to limit Commodity Credit Corporation amounts available for the conservation security program for FY 2005 through 2014.

New Shipper Review Amendment Act of 2004 - Amends the Tariff Act of 1930 with respect to with respect to reviews by the administering authority to establish an individual weighted average dumping margin or an individual countervailing duty rate (as the case may be) for a new exporter or producer that: (1) did not export the merchandise that was the subject of an antidumping duty or countervailing duty order to the United States during the period of investigation; and (2) was not affiliated with any exporter or producer who did. Suspends, until three years after enactment of this Act, the requirement that the administering authority direct the Customs Service to allow, at the option of the importer of such merchandise, the posting, until completion of the review, of a bond or security in lieu of a cash deposit for each entry of the subject merchandise (bonding privileges).

Troops Phone Home Free Act of 2004 - Requires the Secretary of Defense to provide, wherever practicable, prepaid phone cards, or an equivalent telecommunications benefit which includes access to telephone service, to members of the Armed Forces deployed outside the United States who are directly supporting Operation Iraqi Freedom or Operation Enduring Freedom to enable such members to make telephone calls to family and friends in the United States without cost to the member. Limits the value of such benefit to not more than $40 per month per person. Terminates such benefit on the date that is 60 days after the date on which the Secretary determines that both Operation Iraqi Freedom and Operation Enduring Freedom have ended.

Railroad Security and Public Awareness Act of 2004 - Directs the Secretary of Homeland Security to develop and issue detailed guidance for a rail worker security training program to prepare front-line workers for potential threat conditions. Requires railroad carriers to develop a rail worker security training program that meets the Secretary's approval. Authorizes the Secretary to make grants to railroads (including intercity, heavy, and light rail), hazardous materials shippers, owners of hazardous materials rail cars, universities, colleges, and research centers, and State and local governments (for railroad facilities and infrastructure) for full or partial reimbursement of: (1) rail worker security training program costs; and (2) security upgrade costs incurred by a railroad to prevent or respond to acts of terrorism, sabotage, or other railroad security threats. Directs the Secretary to develop a national plan for public outreach and awareness of measures that the general public, railroad passengers, and railroad employees can take to increase railroad security.

Senior Elder Care Relief and Empowerment (SECURE) Act - Amends the Internal Revenue Code to allow a nonrefundable income tax credit for 50 percent of expenses exceeding $1,000 that are incurred for the care of chronically ill individuals who have attained normal retirement age (as determined under the Social Security Act). Allows the credit for certain long-term care services, respite care, or adult day care, but disqualifies expenses that are compensated by insurance or paid to a nursing facility.

Amends the Harmonized Tariff Schedule of the United States to suspend, through December 31, 2006, the duty on electron guns for cathode ray tubes (CRT's) with a high definition television screen aspect ratio of 16:9, liquid crystal display (LCD) panel assemblies for use in LCD projection type televisions, and plasma display panels for use in plasma flat screen televisions.

Direct Support Professional Fairness and Security Act of 2004 - Amends title XIX (Medicaid) of the Social Security Act to provide funds to States to enable them to increase the wages paid to targeted direct support professionals in providing services to individuals with disabilities under the Medicaid program. Directs the Secretary of Health and Human Services, through the Inspector General of the Department of Health and Human Services, to audit a sample from among the States in order to assess the effectiveness of progress made in reducing or eliminating the wage gap between targeted and reference direct support professionals through funds under this Act. Requires the Comptroller General to study and report to Congress on the wage equalization and recruitment and retention of direct support professionals who are providing services and supports to individuals with disabilities.

No Child Left Behind Improvement and Flexibility Act of 2004 - Amends the Elementary and Secondary Education Act of 1965 (ESEA) to revise certain requirements which were added by the No Child Left Behind Act of 2001, including ones relating to: (1) academic assessments and adequate yearly progress; (2) teacher qualifications; (3) special education students; and (4) rural schools.

Dam Rehabilitation and Repair Act of 2004 - Amends the National Dam Safety Program Act to require the Director of the Federal Emergency Management Agency (FEMA) to establish a program to provide grant assistance to States for use in rehabilitating publicly-owned dams that fail to meet minimum safety standards and pose an unacceptable risk to the public (deficient dams). Sets forth provisions regarding procedures for grant awards and fund allocation. Requires the Director to develop a risk-based priority system for identifying deficient dams for which such grants may be made. Limits the Federal share of rehabilitation costs to 65 percent.

Amends the International Air Transportation Competition Act of 1979 to add Tennessee to the number of States outside Texas between which and Love Field, Texas, flights are authorized, if the air carrier: (1) does not offer or provide any through service or ticketing with another air carrier or foreign air carrier; and (2) does not offer for sale transportation to or from, and the flight or aircraft does not serve, any point which is outside Tennessee.

Count Every Vote Act of 2004 - Amends Federal law to extend the date provided for the meeting of electors of the President and Vice President in the States, and the date provided for the joint session of Congress held for the counting of electoral votes, in the event of an unresolved controversy or contest relating to the counting of votes in any State. Changes the date for the meeting of electors, in such an event, from the first Monday after the second Wednesday in December following their appointment to the first day after January 1 following their appointment. Changes the date for the counting of electoral votes in a joint session of Congress from the sixth day of January succeeding the meeting of the electors in the States to the second day following the extended deadline for the receipt of certificates and votes by the President of the Senate or the Archivist of the United States. Reduces from six to three days the "safe harbor" period for resolution of any controversy or contest regarding appointment of State electors.

Armed Forces Voluntary Immunization and Health Justice Act of 2004 - Prohibits requiring a member of the Armed Forces to participate in either of the smallpox or anthrax vaccine immunization programs of the Department of Defense. Permits administering either vaccine to any such member without the informed consent of the member. Requires the correction of the records of servicemembers previously punished for refusing to take either vaccine. Requires the Secretary of Defense to assess the current threat of an anthrax or smallpox attack on members of the Armed Forces and report the results. Requires the Secretary of Veterans Affairs to: (1) carry out an ongoing assessment of the adverse health effects being reported by members and former members of the Armed Forces with respect to the smallpox and anthrax vaccines administered by the Department of Defense; and (2) prepare an estimate of the future cost to the Department of Veterans Affairs to treat those adverse health effects, if determined to be service-connected. Requires the President to establish a National Center for Military Deployment Health Research to coordinate and synthesize research efforts by Federal departments and agencies relating to the health effects of military deployments on members of the Armed Forces, including members of the reserve components.

Boutique Fuels Reduction Act of 2004 - Amends the Clean Air Act (CAA) to authorize the Administrator of the Environmental Protection Agency to temporarily waive controls or prohibitions on the use of a fuel or fuel additive regulated under specified provisions of that Act or prescribed in an applicable State Implementation Plan (SIP) if the Administrator determines that: (1) extreme and unusual circumstances exist in a State or region that prevent distribution of an adequate supply of the fuel or fuel additive to consumers; (2) such circumstances are the result of a natural disaster, an Act of God, a pipeline or refinery equipment failure, or another unforeseeable event; and (3) it is in the public interest to grant the waiver. Permits such a waiver only if it: (1) applies to the smallest necessary geographic area; (2) is effective for 20 days or the shortest practicable time period; (3) permits a transitional period after the termination of the temporary waiver to allow wholesalers and retailers to blend down their inventory; (4) applies to all persons in the motor fuel distribution system; and (5) is preceded by public notice to all parties in the distribution system, local and State regulators, public interest groups, and consumers in the State or region covered by the waiver. States that the Administrator shall have no authority, when considering a SIP or SIP revision regarding State controls or prohibitions on motor vehicle fuel or fuel additives, to approve any fuel: (1) if doing so would increase the total number of approved and fully implemented fuels as of September 1, 2004, in all SIPs; and (2) unless that fuel was approved and fully implemented in at least one SIP in the applicable Petroleum Administration for Defense District (with the exception of fuels with a specified summertime Reid Vapor Pressure). Requires the Administrator and the Secretary of Energy jointly to study and report to Congress on the effects on air quality, number of fuel blends, fuel availability, fuel fungibility, and fuel costs of SIPs adopted pursuant to CAA provisions regarding State controls or prohibitions on motor vehicle fuel or fuel additives.

Employee Freedom from Invasion of Privacy Act - Prohibits employers from engaging in video or audio monitoring of employees in restroom facilities, dressing rooms, or other areas in which it is reasonable to expect employees to change clothing. Establishes maximum civil penalties for violators. Requires the Secretary of Labor to: (1) provide written notice and an opportunity for a hearing before assessing penalties; and (2) determine the amount of penalties taking into account the nature of the violation and specified factors with respect to the violator. Authorizes judicial review of an assessment order for employers who requested a hearing. Authorizes the Attorney General to file suit to recover civil penalties assessed under this Act if an employer fails to pay. Authorizes the Secretary to commence civil actions for injunctive relief to prevent violations of this Act. Authorizes employees aggrieved by an employer's violation of this Act to commence a civil action against the employer for injunctive relief, damages (if the violation is knowing), or both. Asserts that this Act does not alter State law or collective bargaining agreements except where inconsistent with this Act.

Tax Empowerment and Relief for Farmers and Fishermen (TERFF) Act - Amends the Internal Revenue Code to: (1) allow certain commercial farming and fishing businesses a tax deduction for cash contributions (up to 20 percent of taxable income) to a Farm, Fishing, and Ranch Risk Management Account (FFARRM Account); (2) exempt agricultural bonds from private activity bond volume caps; (3) allow individuals a tax deduction for charitable contributions of food (currently restricted to C corporations); (4) extend income averaging to fishermen (currently allowed for farmers) and exclude income averaging for farmers and fishermen from the computation of the alternative minimum tax; (5) modify cooperative marketing rules to include value-added processing involving animals; (6) permit farmer cooperatives to seek declaratory judgments with respect to their tax-exempt status; and (7) allow the allocation of the small ethanol tax credit amounts to patrons of tax-exempt cooperatives. Amends the Code and title II (Old Age, Survivors and Disability Insurance) of the Social Security Act to exclude certain rental income and conservation reserve program payments from the self-employment tax. Provides that dividends on the capital stock or other proprietary capital interests of tax-exempt cooperatives shall not reduce the net earnings of such cooperatives. Modifies involuntary conversion rules to extend from two to four years the replacement period for livestock sold due to drought, flood, or other weather-related conditions.

Requires the Secretary of Transportation to determine apportionments of Federal highway funds to the States by using the amount of tax receipts that the Secretary estimates would have resulted for a fiscal year had any increase in taxes on fuels containing alcohol enacted after this Act taken effect at the beginning of such fiscal year.

Education for All Act of 2004 - Amends the Foreign Assistance Act of 1961 to establish as a policy priority of the United States the achievement of universal education by working with foreign countries and international organizations to: (1) assist developing countries committed to serious reforms in providing all children with quality elementary and secondary education; and (2) provide incentives to encourage educational system reform and educational service improvement in countries lacking such commitment. Requires the President to establish an Education for All Task Force to carry out such policy and to develop a unified strategy to promote universal basic education. Authorizes the President to provide funds or other assistance to eligible entities to assist a foreign country in developing and implementing a comprehensive national education plan that allows its citizens to access and complete basic education. Sets forth requirements for such plans. Authorizes the Administrator of the U.S. Agency for International Development (USAID) to establish an education fellowship program at USAID to increase the expertise of agency personnel in promoting universal basic education and to carry out this Act.

Amends the Help America Vote Act of 2002 to require a State to apply the same self-identification requirements currently applicable to voters who register by mail to those voters who do not register in person with an officer or employee of a State or local government entity. Amends the Voting Rights Act of 1965 and the National Voter Registration Act to provide for increased penalties relating to fraudulent voter registration in cases involving ten or more violations.

Amends title XIX (Medicaid) of the Social Security Act to extend through September 2005 Medicare cost-sharing for the Medicare part B premium for qualifying individuals for additional low-income medicare beneficiaries. Revises requirements for the total allocation amount for three specified periods between January 1, 2004, and September 30, 2005.

High Risk Pool Flexibility Act of 2004 - Amends the Public Health Service Act to expand the definition of "qualified high risk pool" for grant purposes to allow a State to meet the requirement to provide all eligible individuals with health insurance coverage by utilizing an acceptable alternative mechanism that includes a high risk pool as a component and: (1) that provides for risk adjustment, risk spreading, or a risk spreading mechanism (among issuers or policies of an issuer) or for some financial subsidization for eligible individuals, including through assistance to participating issuers; or (2) under which each eligible individual is provided a choice of all individual health insurance coverage otherwise available.
