Grants the consent and approval of Congress to amendments made by Maryland, the Commonwealth of Virginia, and the District of Columbia to article III of title I of the Washington Metropolitan Area Transit Regulation Compact to revise the composition of the Washington Metropolitan Area Transit Commission. States that the Commission shall be composed of three members, one member appointed by the Governor of Virginia from the Department of Motor Vehicles of the Commonwealth of Virginia, one member appointed by the Governor of Maryland from the Maryland Public Service Commission, and one member appointed by the Mayor of the District of Columbia from a District agency with oversight of matters relating to the Commission. Declares that such amendment to the article shall not affect any member in office on its effective date.

Includes the Puyallup Tribe, the Swinomish Indian Tribal Community, or the Kalispel Tribe of Indians among those tribes and tribal organizations permitted to lease restricted lands under specified conditions without the Secretary of the Interior's approval.

Regulated Investment Company Modernization Act of 2009 - Amends the Internal Revenue Code, with respect to regulated investment companies (RICs), to: (1) permit RICs an unlimited carryforward of their net capital losses; (2) eliminate restrictions on the investment of RICs in commodities; (3) limit penalties for failure of RICs to satisfy gross income and asset tests; (4) modify rules for allocating RIC capital gain dividend distributions; (5) include certain nondeductible items of RIC income in earnings and profit calculations; (6) allow RICs that invest exclusively in the shares of other RICs to pass through to their shareholders tax-exempt interest and foreign tax credits, without regard to certain investment limitations; (7) modify rules relating to the declaration of RIC dividends, return of capital distributions, and stock redemptions; (8) allow certain RICs with shares that are redeemable upon demand to treat distributions in redemption of stock as an exchange of fund shares or a dividend for tax purposes; (9) allow a deferral of end-of-year losses of RICs; and (10) modify excise tax and penalty rules applicable to RICs.

Miscellaneous Trade and Technical Corrections Act of 2009 - Amends the Harmonized Tariff Schedule of the United States to provide for duty suspensions and reductions through December 31, 2012, for specified chemicals and other products. Extends existing suspensions and reductions of duties through December 31, 2012, for other specified chemicals and products. Imposes, suspends, and increases and/or decreases the duty on certain chemicals through December 31, 2012. Extends, through December 31, 2012, the suspension of duty on certain products. Imposes, through December 31, 2012, a duty on: (1) brakes designed for bicycles; and (2) certain 12V lead-acid storage batteries. Suspends, through December 31, 2012, the duty on: (1) certain catalytic converter mats of ceramic fibers; and (2) certain herbicides. Extends the duty on aspirin through December 31, 2012. Amends the Consolidated Omnibus Budget Reconciliation Act of 1985 (COBRA) to extend certain customs fees for the processing of merchandise entered into the United States through June 14, 2018, and June 28, 2018, respectively. Amends the Corporate Estimated Tax Shift Act of 2009 to increase the estimated tax payments of corporations with at least $1 billion in assets in the third quarter of 2014 by 0.75%.

Amends the Trade Act of 1974 to extend duty-free treatment under the Generalized System of Preferences from December 31, 2009, through December 31, 2010. Amends the Andean Trade Preference Act (ATPA) to extend the ATPA program through December 31, 2010. Extends through FY2010 preferential treatment for apparel articles assembled in one or more beneficiary countries from regional fabrics or regional components, and specified other type apparel (brassieres). Advances from April 30, 2003, to June 30, 2010, the base scheduling date for biennial reports to Congress of the United States Trade Representative (USTR) on the operation of ATPA. Amends the Consolidated Omnibus Budget Reconciliation Act of 1985 to extend customs fees for the processing of specified different kinds of merchandise entered into the United States: (1) from February 14, 2018, through May 14, 2018; and (2) from February 7, 2018, through June 7, 2018. Amends the Tax Increase Prevention and Reconciliation Act of 2005 to increase by 1.5% (to 101.75% of such amount) the amount in effect on the date of enactment of this Act of any corporate estimated tax installment otherwise due by a corporation with assets of not less than $1 billion in July, August, or September 2014.

Congressional Award Program Reauthorization Act of 2009 - Amends the Congressional Award Act to revise requirements for appointment and reappointment of members of the Congressional Award Board, especially the limitation of service on the Board to two consecutive terms. Exempts a member from the two-term limit during a period of service as Board Chairman. Permits reappointment of such individual to an additional full term after termination of such Chairmanship. Requires a Board member's term to begin on October 1 of the even numbered year, with one-half of the Board positions having terms which begin in each even numbered year. Changes from calendar to fiscal year the annual period for which the Director is required to ensure that the Board's liabilities do not exceed its assets. Requires the Board, if the Comptroller General finds that the Director has not substantially complied with such duty, to: (1) instruct the Director to take such necessary actions to correct any deficiencies (as under current law); and (2) remove and replace the Director if they are not promptly corrected. Repeals the requirement that, upon a Director's failure to correct such deficiencies, the Board take necessary action to prepare for the orderly cessation of Board activities. Allows the Board to accept funds to carry out its functions and make expenditures that are awarded in any grant program administered by a federal agency. (Currently the Board is prohibited from using federal resources.) Repeals the limitation on contributions to Statewide Congressional Award Councils to public monetary and in-kind contributions for Program purposes (thus allowing private contributions as well). Allows the donation of funds or other resources to restrict their use to scholarships. Names the nonprofit corporation the Board is required to establish to assist it in carrying out the Program the Congressional Award Foundation. Repeals the requirement that the corporation be private. Treats the Foundation together with any subsidiary nonprofit corporations as the collective Corporation to which appropriate duties shall be delegated, including the employment of personnel, expenditure of funds, and the incurrence of financial or other contractual obligations. Allows the Congressional Award Board (which as under current law shall be members of the Board of Directors of the Foundation) to appoint up to 24 additional voting members to the Foundation Board. Makes the Congressional Award Program Director serve as a nonvoting member of the Foundation Board. Extends the Congressional Award Board until October 1, 2013.

Federal Supply Schedules Usage Act of 2009 - Authorizes the Administrator of General Services (GSA) to provide for the use of federal supply schedules by the American National Red Cross. Prohibits use of such authority to purchase supplies for resale. Requires all uses of federal supply schedules to be in accordance with the ordering guidance provided by the Administrator. Authorizes the Administrator to include among permitted uses of federal supply schedules by state or local governments the procurement of goods or services to facilitate disaster preparedness or response.

Commercial Advertisement Loudness Mitigation Act or the CALM Act - Directs the Federal Communications Commission (FCC) to prescribe a regulation limiting the volume of television advertisements that is limited to incorporating by reference the "Recommended Practice: Techniques for Establishing and Maintaining Audio Loudness for Digital Television" insofar as such recommended practice concerns the transmission of commercial advertisements by a television broadcast station, cable operator, or other multichannel video programming distributor.

Fiscal Year 2010 Federal Aviation Administration Extension Act, Part II - Amends the Internal Revenue Code to extend through March 31, 2010: (1) excise taxes on aviation fuels and air transportation of persons and property; and (2) the expenditure authority for the Airport and Airway Trust Fund. Authorizes appropriations for the six-month period from October 1, 2009, through March 31, 2010, for airport improvement program (AIP) projects, including project grant authority. Sets forth a formula for calculating the apportionment of AIP funding. Extends through March 31, 2010, various airport development projects, including: (1) the pilot program for passenger facility fees at nonhub airports; (2) small airport grants for airports located in the Marshall Islands, Micronesia, and Palau; (3) the temporary increase to 95% in the government share of certain AIP project costs; and (4) the funding of Midway Island airport development. Extends through March 31, 2010, state and local land use compatibility projects under the AIP program. Extends through March 31, 2010, the authority of the Metropolitan Washington Airports Authority to apply for an airport development grant and impose a passenger facility fee. Extends through March 31 2010, Department of Transportation (DOT) insurance coverage for domestic and foreign-flag air carriers. Allows further extension through June 30, 2010. Extends through June 30, 2010, air carrier liability limits for injuries to passengers resulting from acts of terrorism. Extends through March 31, 2010, certain competitive access assurance requirements for large or medium hub airport sponsors applying for AIP grants. Extends for the six-month period beginning October 1, 2009, the authorization of appropriations for: (1) Federal Aviation Administration (FAA) operations; (2) air navigation facilities and equipment; and (3) research, engineering, and development.

No Social Security Benefits for Prisoners Act of 2009 - Amends titles II (Old Age, Survivors and Disability Insurance) (OASDI) and XVI (Supplemental Security Income) (SSI) of the Social Security Act to prohibit retroactive payments to individuals during periods for which such individuals are prisoners, fugitive felons, or probation or parole violators.

Tax Extenders Act of 2009 - Amends the Internal Revenue Code to extend through 2010 certain expiring provisions for individual taxpayers, including: (1) the taxpayer election to deduct state and local general sales taxes in lieu of state and local income taxes; (2) the standard tax deduction for state and local real property taxes; (3) the tax deduction from gross income for qualified tuition and related expenses; and (4) the tax deduction from gross income for certain expenses of elementary and secondary school teachers. Extends through 2010 expiring provisions for business taxpayers, including: (1) the tax credit for increasing research activities; (2) tax treatment of certain items affecting U.S. shareholders of controlled foreign corporation; (3) accelerated depreciation for qualified leasehold, restaurant, and retail property, for motorsports entertainment complexes, and for farming business machinery and equipment; (4) the tax credit for railroad track maintenance expenditures; (5) the enhanced expensing allowance for certain film and television production costs; (6) expensing of environmental remediation costs; (7) the tax credit for mine rescue team training expenses; (8) the taxpayer election to expense advanced mine safety equipment expenditures; (9) the tax credit for differential wages payments to employees who are active duty members of the Uniformed Services; (10) tax rules relating to regulated investment companies (RICs); and (11) the suspension of the taxable income limitation on percentage depletion for oil and natural gas produced from marginal properties. Extends through 2010 expiring provisions relating to charitable organizations and contributions, including: (1) the tax deduction for charitable contributions of capital gain real property by individual taxpayers and certain corporate farmers and ranchers for conservation purposes; (2) the enhanced tax deduction for charitable contributions of food inventory and book inventories to public schools and for corporate contributions of computer technology and equipment for educational purposes; (3) penalty-free distributions from individual retirement accounts (IRAs) for charitable purposes; and (4) special tax rules for payments to controlling exempt organizations, exclusion of gain or loss from unrelated business taxable income from the sale or exchange of certain brownfield sites, and basis adjustment to stock of S corporations making charitable contributions. Extends through 2010: (1) the tax credit for employment of members of Indian tribes; (2) accelerated depreciation of property used for business purposes on an Indian reservation; (3) extension of the tax deduction for income attributable to domestic production activities to such activities in Puerto Rico; (4) the limitation on the amount of distilled spirits tax covered (paid over) into the treasuries of Puerto Rico and the Virgin Islands; and (5) the tax credit for American Samoa economic development expenditures. Extends through 2010 certain provisions relating to community development and assistance, including: (1) tax incentives in empowerment zones and renewal communities; (2) the new markets tax credit; (3) tax incentives for investment in the District of Columbia, the New York Liberty Zone, the Gulf Opportunity Zone, and low-income housing. Extends through 2010 tax-related disaster relief provisions, including: (1) the tax deduction for personal casualty losses attributable to federally-declared disasters; (2) expensing allowance for cleanup and other expenditures in disaster areas; (3) the five-year extended carryover period for net operating losses incurred in a disaster area; (4) waiver of mortgage revenue bond requirements for refinancing residences damaged or destroyed in a disaster area; and (5) expensing and accelerated depreciation of certain disaster assistance property. Extends through 2010 energy conservation and production provisions, including: (1) the tax credits for biodiesel and renewable diesel used as fuel; (2) the alternative motor vehicle tax credit for large hybrid vehicles; (3) the alternative fuel excise tax credit for natural gas and liquefied petroleum gas; and (4) tax rules relating to sales required to implement federal and state restructuring policy for qualified electric utilities. Revises and adds reporting and other requirements relating to income from assets held abroad, including by: (1) requiring foreign financial and nonfinancial institutions to withhold 30% of payments made to such institutions by U.S. individuals unless such institutions agree to disclose the identity of such individuals and report on their bank transactions; (2) denying a tax deduction for interest on non-registered bonds issued outside the United States; (3) requiring any individual who holds more than $50,000 in a depository or custodial account maintained by a foreign financial institution to report on such accounts; (4) imposing an enhanced tax penalty for underpayments attributable to undisclosed foreign financial assets; (5) extending the limitation period for assessment of underpayments with respect to assets held outside the United States; (6) requiring shareholders of a passive foreign investment company to file informational returns; (7) enhancing tax rules and penalties relating to foreign trusts with U.S. beneficiaries; and (8) requiring withholding of tax on dividend equivalent payments received by foreign individuals. Sets forth tax rules relating to partnership interests transferred in connection with the performance of services. Increases by an additional 26.5% the required estimated tax payments for certain large corporations in the third quarter of 2014. Requires the Chief of Staff of the Joint Committee on Taxation to submit to the House Ways and Means Committee and the Senate Finance Committee a report on each tax expenditure extended by this Act.

Wall Street Reform and Consumer Protection Act of 2009 - Financial Stability Improvement Act of 2009 - Directs the Comptroller General to audit and report to Congress on all actions taken by the Board of Governors of the Federal Reserve System (Federal Reserve Board) and the Federal Reserve Banks during the current economic crisis pursuant to specified authority granted under the Federal Reserve Act. Establishes a Financial Services Oversight Council, consisting of the heads of specified federal financial regulatory bodies and chaired by the Secretary of the Treasury, to: (1) resolve a dispute among two or more federal financial regulatory agencies in specified circumstances; (2) subject a financial company to stricter prudential standards; and (3) require a financial holding company to undertake one or more mitigatory actions to address any grave threat its activities pose to the financial stability or economy of the United States. Directs the Federal Reserve Board to impose stricter prudential standards on a financial holding company in certain circumstances. Authorizes the Council to subject a financial activity or practice to stricter prudential standards for financial stability purposes. Amends the Home Owners' Loan Act to establish a Division of Thrift Supervision within the Office of the Comptroller of the Currency. Abolishes the Office of Thrift Supervision and transfers its functions and personnel to the Division. Amends the Revised Statutes of the United States to direct the Secretary to appoint up to five Deputy Comptrollers of the Currency, including a Senior Deputy Comptroller for National Banks and a Senior Deputy Comptroller for Thrift Supervision. Amends the Federal Deposit Insurance Act (FDIA) to place the Chairman of the Federal Reserve Board on the Board of Directors of the Federal Deposit Insurance Corporation (FDIC) in lieu of the Director of the Office of Thrift Supervision. Amends the Bank Holding Company Act of 1956 to prescribe requirements for the treatment of industrial loan companies, savings associations, special purpose holding companies, and certain other companies. Prohibits certain conversions of troubled banks and thrifts. Amends the FDIA to revise requirements for calculating a depository institution's assessment. Credit Risk Retention Act of 2009 - Amends the Securities Act of 1933 to direct the appropriate federal financial regulatory agencies to prescribe regulations to require any creditor to retain an economic interest in a material portion of the credit risk of any loan the creditor transfers, sells, or conveys to a third party, including for the purpose of including such loan in a pool of loans backing an issuance of asset-backed securities. Dissolution Authority for Large, Interconnected Financial Companies Act of 2009 - Prescribes a procedure under which the Secretary shall appoint the FDIC as receiver for one year to resolve, liquidate, or take other specified emergency stabilization actions with respect to a financial company whose imminent or actual default would have serious adverse effects on financial stability or economic conditions in the United States. Requires the FDIC Inspector General, if the Secretary appoints the FDIC as receiver for a financial company, to establish an Office of Resolution to audit and investigate the activities of the FDIC in its capacity as receiver for that company. Amends the Federal Reserve Act to prescribe requirements for financial crisis management actions by the Federal Reserve Board in the event of a liquidity event that could destabilize the U.S. financial system. Establishes a Council of Inspectors General on Financial Oversight. Amends the International Banking Act of 1978 to authorize the Federal Reserve Board to terminate the activities of the U.S. branch, agency, or subsidiary of a foreign bank that presents a systemic risk to the United States. Corporate and Financial Institution Compensation Fairness Act of 2009 - Amends the Securities Exchange Act of 1934 to require a separate, non-binding shareholder vote to approve the compensation, including golden parachute compensation, of corporate and financial institution executives. Requires each member of the compensation committee of the board of directors of an issuer of securities to be independent. Over-the-Counter Derivatives Markets Act of 2009 - Amends the Commodity Exchange Act to require joint regulation of swap markets by the Commodity Futures Trading Commission (CFTC) and the Securities and Exchange Commission (SEC). Requires swap repositories, swap dealers, major swap participants, and swap execution facilities to register with the CFTC. Repeals the exemption from CFTC regulation of derivatives transaction execution facilities and boards of trade. Revises requirements for foreign boards of trade. Authorizes the CFTC and the SEC to ban: (1) abusive swaps; and (2) access to the U.S. financial system of any entity domiciled in a foreign country whose regulation of swaps or security-based swaps markets in that country undermines the stability of the U.S. financial system. Amends the Securities Exchange Act of 1934 to repeal the prohibition on regulation of security-based swaps and applies specified requirements to such swaps. Consumer Financial Protection Agency Act of 2009 - Establishes the Consumer Financial Protection Agency (CFPA) as an independent agency to regulate the provision of consumer financial products or services. Prescribes related requirements for examination and enforcement for small insured depository institutions (with total assets of $10 billion or less) by the FDIC and credit unions (with total assets of $1.5 billion or less) by the National Credit Union Administration (NCUA). Directs the CFPA to develop risk-based programs to supervise nondepository covered persons. Authorizes the CFPA to take actions to prohibit unfair, deceptive, or abusive acts or practices in connection with any transaction with a consumer for, or any offering of, a consumer financial product or service. Specifies prohibited acts. Requires the CFPA Director to lead a Negotiated Rulemaking Committee to promulgate appraisal independence requirements for residential loan purposes. Specifies the preservation of the civil enforcement powers of state attorneys general. Prescribes standards for federal preemption of state law regarding national banks and subsidiaries and federal savings associations. Specifies CFPA enforcement powers. Transfers to the CFPA the consumer financial protection functions of the Federal Reserve Board, the Comptroller of the Currency, the Office of Thrift Supervision, the FDIC, the Federal Trade Commission, the NCUA, and the Secretary of Housing and Urban Development (HUD). Prescribes requirements for the collection and use by the CFPA of deposit account and small business data. Requires the CFPA Director to conduct an annual financial autopsy regarding bankruptcies and foreclosures, including any specific financial products or services that have caused substantial numbers of them. Private Fund Investment Advisers Registration Act of 2009 - Amends the Investment Advisers Act of 1940 to require private fund investment advisers to register with the SEC and maintain records and make reports on systemic risk data. Exempts venture capital fund advisers from the registration requirements. Directs the SEC to exempt from registration requirements any investment adviser of a private fund with assets under management in the United States of less than $150 million. Accountability and Transparency in Rating Agencies Act of 2009 - Amends the Securities Exchange Act of 1934 to revise requirements for regulation of nationally recognized statistical rating organizations (NRSROs). Requires the SEC to examine NRSRO credit ratings to review whether an NRSRO has established a system of internal controls and adhered to it. Directs the SEC to: (1) establish an office to administer SEC rules with respect to NRSRO practices; and (2) eliminate the exemption of NRSROs from the Fair Disclosure Rule. Directs the SEC to establish a Credit Ratings Agency Advisory Board. Investor Protection Act of 2009 - Amends the Securities Exchange Act of 1934 to establish an Investor Advisory Committee to the SEC. Authorizes the SEC to engage in consumer testing. Amends the Securities Exchange Act of 1934 and the Investment Advisers Act of 1940 to direct the SEC to promulgate rules to prescribe a fiduciary standard of conduct for a broker or dealer when providing personalized investment advice about securities to a retail customer. Authorizes the SEC to prohibit or limit agreements that require customers or clients of any broker, dealer, or municipal securities dealer to engage in pre-dispute arbitration. Establishes within the SEC a Capital Markets Safety Board. Directs the SEC to report to specified congressional committees on the implementation of SEC reforms in the wake of the discovery of fraud by Bernie Madoff. Authorizes the SEC and the CFTC to form and operate a joint advisory committee. Prescribes or revises prohibitions and requirements relating to: (1) securities lending; (2) lost and stolen securities; and (3) fingerprinting of personnel of registered securities information processors, national securities exchanges, and national securities associations. Declares that any condition, stipulation, or provision binding any person to waive compliance with any rule of a self-regulatory organization shall be void. Directs the Comptroller General to study and report to Congress on the SEC revolving door. Establishes a Financial Reporting Forum to discuss immediate and long-term issues critical to financial reporting. Directs the SEC Chairman to appoint an SEC Ombudsman. Amends the Securities Investor Protection Act of 1970 with respect to, among other specified items, an increased: (1) assessment paid by Securities Investor Protection Corporation (SIPC) members; (2) borrowing limit on Treasury loans; and (3) cash limit of protection. Amends the Sarbanes-Oxley Act of 2002 with respect to: (1) the Public Company Accounting Oversight (PCAO) Board oversight of auditors of brokers and dealers; and (2) foreign regulatory information sharing, and related matters. Directs the PCAO Board to appoint an ombudsman. Directs the SEC to establish a program of grants to states for enhanced protection of seniors from misleading and fraudulent marketing of financial products. Amends the Securities Exchange Act of 1934 to require municipal financial advisers to register with the SEC. Federal Insurance Office Act of 2009 - Establishes in the Treasury the Federal Insurance Office (FIO) to: (1) monitor the insurance industry; (2) recommend to the Financial Services Oversight Council that it designate an insurer as one subject to stricter standards; (3) assist in administering the Terrorism Insurance Program; and (4) perform other related duties. Preempts a state insurance measure only to the extent it: (1) directly results in less favorable treatment of a non-U.S. insurer domiciled in a foreign jurisdiction that is subject to a covered agreement than a U.S. insurer domiciled, licensed, admitted, or otherwise authorized in that state; and (2) is inconsistent with such a covered agreement. Requires the FIO Director to study and report to specified congressional committees on: (1) the global reinsurance market; and (2) how to modernize and improve the system of insurance regulation in the United States.

Redundancy Elimination and Enhanced Performance for Preparedness Grants Act - Amends the Homeland Security Act of 2002 to direct the Administrator of the Federal Emergency Management Agency (FEMA), for homeland security preparedness grants (under the Urban Area Security Initiative and under the State Homeland Security Grant Program) and other grants specified by the Administrator, to submit a report to the congressional homeland security committees every two years that: (1) identifies redundant reporting requirements for grant recipients and includes a plan for eliminating such redundancies; (2) includes a plan for developing and improving the performance metrics required for such grants; and (3) includes an assessment of each program under which such grants are awarded. Requires each plan to: (1) be developed in coordination with state, local, tribal, and territorial governments; and (2) include a proposed timeline for actions to implement the plan. Lists requirements for program assessments, including: (1) a brief summary of program purposes, objectives, performance goals, and key findings; (2) an assessment of the quality of the program's performance metrics; (3) a summary of how the program's strengths and weaknesses are impeding or contributing to its failures or successes; (4) an identification of best practices used for allocating resources that resulted in positive outcomes; and (5) an assessment of the quality of customer service offered to recipients of funds under the program and a strategy for improving such service.

First Responder Anti-Terrorism Training Resources Act - Amends the Implementing Recommendations of the 9/11 Commission Act of 2007 to authorize the Secretary of Homeland Security (DHS) to accept gifts of property and services for otherwise authorized activities of the Center for Domestic Preparedness that are related to preparedness for and response to terrorism. Directs the Secretary to report to Congress annually regarding such gifts.

Medicare Physician Payment Reform Act of 2009 - Amends title XVIII (Medicare) of the Social Security Act to revise the Medicare sustainable growth rate (SGR) payment system for determining the annual updates to the Medicare physician fee schedule. Sets as a transitional update for 2010 to the single conversion factor in the formula for determining the schedule the percentage increase in the Medicare economic index (MEI, a price index of inputs required to produce physician services). Rebases the update adjustment factor for 2011 and subsequent years by: (1) making the allowed expenditures for 2009 under the schedule equal to the actual expenditures for physicians' services during 2009; and (2) changing from 1996 to 2009 (or, if later, the fifth year before the year involved) the reference point for calculating the cumulative adjustment component to expenditure targets in the formula. Limits to physicians' services under the fee schedule (excluding those incidental to a physician visit) the services covered in the target growth rate computation. Establishes two categories of physician services: (1) evaluation, management, and preventive services; and (2) all other physician services. Prescribes a separate target growth rate and conversion factor update for each such category.

Affordable Health Care for America Act - Requires the Secretary of Health and Human Services (HHS) to establish: (1) a temporary national high-risk pool program to provide health benefits to certain uninsured individuals who have a medical condition; and (2) a temporary reinsurance program to assist participating employment-based plans with the cost of providing health benefits to retirees and their beneficiaries. Amends the Public Health Service Act, the Employee Retirement Income Security Act of 1974 (ERISA), and the Internal Revenue Code to set forth provisions governing health insurance plans and issuers, including to: (1) provide for rebates to enrollees based on a plan's medical loss ratio (a ratio of medical expenses paid to premiums received); (2) prohibit rescission of health insurance coverage without clear and convincing evidence of fraud; (3) require the option of extending coverage for children under 27 years of age; (4) limit preexisting condition exclusions; and (5) prohibit aggregate dollar lifetime limits on benefits. Extends COBRA coverage (health insurance continuation benefits) until an individual becomes eligible for health insurance coverage through the Health Insurance Exchange under this Act. Provides for grandfathered health insurance coverage. Establishes standards for qualified health benefits plans, including standards to: (1) prohibit any preexisting condition exclusions; (2) require guaranteed availability and renewability of health insurance coverage; (3) limit premium variances, except for reasons of age, area, or family enrollment; (4) prohibit discrimination based on health status factors; and (5) require parity for mental health benefits. Requires qualified health benefits plans to provide coverage that meets the standards for the essential benefits package. Prohibits an essential benefits package from imposing any annual or lifetime limits on coverage. Lists required covered services, including hospitalization, prescription drugs, mental health services, maternity care, and children's oral health, vision, and hearing services. Prohibits cost-sharing for preventive items and services. Limits annual cost-sharing to $5,000 for an individual and $10,000 for a family. Prohibits abortion services from being required under an essential benefits package or under a qualified health benefits plan. Establishes the Health Choices Administration as an independent agency to be headed by a Health Choices Commissioner. Establishes the Health Insurance Exchange within the Administration to facilitate access of individuals and employers to a variety of choices of affordable, quality health insurance coverage, including a public health insurance option. Requires the Commissioner to: (1) contract with entities to offer health benefit plans through the Exchange to eligible individuals; (2) coordinate the distribution of affordability premium and cost-sharing credits; and (3) establish a risk-pooling mechanism for Exchange-participating health plans. Authorizes state-based Health Insurance Exchanges to operate in a state or group of states instead of the Health Insurance Exchange, with approval of the Commissioner. Requires the Commissioner to establish a Consumer Operated and Oriented Plan program (CO-OP program) under which the Commissioner may make grants and loans for the establishment and initial operation of not-for-profit, member-run, health insurance cooperatives that provide insurance through the Health Insurance Exchange or a state-based Health Insurance Exchange. Requires the HHS Secretary to offer an Exchange-participating health benefits plan. Sets forth provisions regarding the operation of the Public Health Insurance Option. Provides for an affordability premium credit and an affordability cost-sharing credit for low-income individuals participating in the Exchange. Requires employers to offer health benefits coverage to employees and make specified contributions towards such coverage or make contributions to the Exchange for employees obtaining coverage through the Exchange. Exempts businesses with payrolls below $500,000 from such requirement. Amends the Internal Revenue Code to: (1) impose a surtax on the income of individuals who do not obtain health care coverage and on employers (other than small business employers) who fail to satisfy health coverage participation requirements; (2) allow a new tax credit for small business employers who provide health care coverage to their employees; (3) increase the penalty for distributions from health savings accounts not used for qualified medical expenses; (4) modify rules and contribution limits for certain employee benefit plans; (5) allow an exclusion from gross income for the value of certain medical care provided to members of Indian tribes; (6) impose a 5.4% surtax on individuals whose adjusted gross income exceeds $500,000 ($1 million for married couples filing joint returns); (7) impose a 2.5% excise tax on medical devices; (8) delay until 2020 tax rules applicable to the foreign tax credit for the worldwide allocation of interest; (9) set forth rules for the application of the economic substance doctrine and impose penalties for underpayments of tax due to transactions lacking economic substance; and (10) extend the tax exemption for employer-provided health care benefits to certain eligible beneficiaries of the taxpayer. Amends title XVIII (Medicare) of the Social Security Act (SSA) to revise provisions relating to payment, coverage, and access, including to: (1) permit physician assistants to order post-hospital extended care services, and to provide for recognition of attending physician assistants as attending physicians to serve hospice patients; (2) provide adjustment to Medicare payment localities for physician services; (3) modify the Medicare payment systems to address geographic inequities; (4) limit cost-sharing for individual health services under the Medicare Advantage program; (5) eliminate the coverage gap under Medicare Part D (Voluntary Prescription Drug Benefit Program); (6) eliminate Medicare part D cost-sharing for certain non-institutionalized full dual eligible individuals; (7) cover marriage and family therapist services and mental health counselor services; and (8) expand access to vaccines. Requires the HHS Secretary to establish within the Agency for Healthcare Research and Quality a Center for Comparative Effective Research. Establishes accountability requirements for long-term care facilities and provides for transparency with respect to them. Provides enhanced penalties for fraud and abuse. Amends title XIX (Medicaid) of the SSA to: (1) expand Medicaid eligibility for low-income individuals and families; (2) require coverage of additional preventive services; and (3) increase payments for primary care services. Sets forth provisions to prevent health care fraud. Sets forth miscellaneous provisions relating to: (1) extension of the qualifying individual (QI) program; (2) the Medicaid and CHIP Payment and Access Commission; (3) prohibitions against federal Medicaid and CHIP payments for undocumented aliens; (4) the repeal of the comparative cost adjustment program; (5) grants to states for quality home visitation programs for families with young children and families expecting children; (6) establishment of the Center for Medicare and Medicaid Innovation; and (7) application of emergency services laws. Amends the Public Health Service Act to set forth provisions related to: (1) community health centers; (2) health care provider scholarship and loan repayment programs; (3) training programs; (4) health care workforce diversity and data collection; and (5) the 340B drug discount program (a program limiting the cost of covered drugs to certain federal grantees). Requires the HHS Secretary to establish: (1) the Advisory Committee on Health Workforce Evaluation and Assessment; (2) a community-based overweight and obesity prevention program; (3) a demonstration project for medical-legal partnerships to assist patients navigating health-related programs and activities; (4) the Emergency Care Coordination Center; (5) the Council of Emergency Care; (6) the Interagency Pain Research Coordinating Committee; (7) a national pain care education outreach and awareness campaign; and (8) a national medical device registry. Establishes: (1) a Prevention and Wellness Trust for carrying out prevention and wellness activities; (2) the Center for Quality Improvement to focus on quality improvement activities in the delivery of health care services; and (3) the position of Assistant Secretary for Health Information. Provides grants for: (1) school-based health clinics; (2) nurse-managed health centers; (3) federally qualified behavioral health centers; (4) influenza vaccinations to children in elementary and secondary schools; (5) evidence-based education programs to reduce teen pregnancy or sexually transmitted diseases; (6) services to children and adults with autism and their families; (7) University Centers for Excellence in Developmental Disabilities Education, Research, and Service; (8) medication management services; (9) infant mortality pilot programs; (10) community-based collaborative care networks; and (11) trauma centers and emergency medical care systems. Requires the HHS Secretary to make an incentive payment to each state that has an alternative medical liability law. Provides for: (1) nutrition labeling of standard menu items offered for sale in chain restaurants and vending machines; and (2) standards to make medical diagnostic equipment accessible to, and usable by, individuals with disabilities. Prohibits certain practices related to patent infringement claims against generic drugs. Allows a person to submit an application for licensure of a biological product based on its similarity to a licensed biological product (the reference product). Establishes a national, voluntary disability insurance program to purchase community living assistance services and supports (CLASS program) under which: (1) all employees are automatically enrolled, but are allowed to waive enrollment; (2) payroll deductions pay monthly premiums; and (3) benefits are provided, based on the level of disability, to purchase nonmedical services and supports that the beneficiary needs to maintain independence. Makes states eligible for federal funds under the Public Health Service Act only if they agree to be subject as an employer to the obligations under this Act. Establishes Offices of Women's Health within HHS and its agencies. Indian Health Care Improvement Act Amendments of 2009 - Amends the Indian Health Care Improvement Act to revise requirements for health care programs and services for Indians, Indian tribes, tribal organizations, and urban Indian organizations. Replaces the Urban Health Programs Branch with a Division of Urban Indian Health. Authorizes grants to urban Indian organizations for health information technology, telemedicine services development, and related infrastructure. Directs the HHS Secretary, acting through the Indian Health Service, to provide programs of comprehensive behavioral health, prevention, and treatment. Reauthorizes the Indian Health Care Improvement Act. Amends the Indian Self-Determination and Education Assistance Act to direct the HHS Secretary to establish the Native American Health and Wellness Foundation. Expands coverage for qualified Indians in the State Children's Health Insurance Program (CHIP, formerly known as SCHIP) under title XXI of the SSA, as well as under Medicare (SSA title XVIII) and Medicaid (SSA title XIX). Authorizes related payments to Indian Health Programs operating in the state.

Caregivers and Veterans Omnibus Health Services Act of 2009 - Revises or adds provisions concerning veterans' caregiver support, including: (1) the waiver of charges for humanitarian care provided to family members accompanying severely injured veterans receiving medical care; (2) lodging and subsistence for attendants; and (3) a survey of informal caregivers. Revises or adds provisions concerning women veterans' health care, including: (1) reports, studies, and pilot programs; (2) care for women veterans suffering from sexual trauma; (3) counseling in retreat settings for women veterans newly separated from service; (4) child care subsidies; and (5) care for newborn children of women veterans receiving maternity care. Revises or adds provisions concerning rural veterans' health care, including: (1) a visual impairment and orientation and mobility professionals education assistance program; (2) the use of teleconsultation and telemedicine; (3) demonstration projects on alternatives for expanding veterans' rural health care; (4) pilot programs and reports; (5) an Office of Rural Health five-year strategic plan; (6) the enhancement of Vet Centers to meet the needs of veterans of Operations Iraqi Freedom and Enduring Freedom; (7) centers of excellence for rural health research, education, and clinical activities; and (8) transportation grants for rural veterans service organizations. Revises or adds provisions concerning veterans' mental health care, including: (1) Iraq and Afghanistan war veterans' eligibility for counseling and services through the Readjustment Counseling Service; and (2) a study on suicides among veterans. Revises or adds provisions concerning other veterans' health care matters, including: (1) disclosures from medical records; (2) health care quality management; (3) pilot programs, studies, and reports; (4) the use of non-Department of Veterans Affairs (VA) facilities for the rehabilitation of veterans with traumatic brain injury; (5) the inclusion of federally-recognized tribal organizations in certain programs for state veterans homes; and (6) a prohibition on the collection of copayments from catastrophically disabled veterans. Revises or adds provisions concerning VA personnel matters, including: (1) authorities for the retention of medical professionals; (2) limitations on overtime and weekend duty, and alternative work schedules, for nurses; and (3) standards for appointment and practice of physicians in VA medical facilities. Revises or adds provisions concerning homeless veterans, including pilot programs on financial support for entities that: (1) coordinate the provision of supportive services to formerly homeless veterans residing on military property and other permanent housing; and (2) provide outreach to inform certain veterans about pension benefits. Revises or adds provisions concerning general authorities, purposes, powers, and accountability and oversight of nonprofit research and education corporations. Designates certain VA medical facilities. Provides expanded authority of, and a uniform allowance for, VA police officers.

Authorizes the Administrator of General Services (GSA) to extend the authority for a relocation expenses test program for federal employees upon the request of the agency administering the program. Requires each such agency to annually submit a report on the results of the program to the Administrator. Increases to 12 the number of test programs that may be conducted simultaneously. Limits approval for any test program to an initial four-year period, with four-year extensions authorized. Repeals a provision disclaiming any intent to limit agency authority to conduct such test programs.

Morris K. Udall Scholarship and Excellence in National Environmental Policy Amendments Act of 2009 - Amends the Morris K. Udall Scholarship and Excellence in National Environmental and Native American Public Policy Act of 1992 to rename: (1) the Act, the Morris K. Udall and Stewart L. Udall Foundation Act; (2) the Morris K Udall Scholarship and Excellence in National Environmental Policy Trust Fund, the Morris K Udall and Stewart L. Udall Trust Fund; (3) the Morris K. Udall Scholarship and Excellence in National Environmental Policy Foundation, the Morris K. Udall and Stewart L. Udall Foundation; and (4) Morris K. Udall Scholars, Udall Scholars. Requires the Executive Director of the Foundation to be paid at a senior executive rate. Directs the Foundation to award grants to the Udall Center for Studies in Public Policy, at the University of Arizona, to conduct training, research, and other activities with regard to the involvement of Native American and Alaska Native professionals in health care and public policy. Allows the use of reasonable amounts of the Trust Fund for official reception and representation expenses, not to exceed $5,000 for a fiscal year. Sets forth administrative provisions that allow the Foundation to: (1) appoint personnel without regard to federal law provisions governing appointments in the competitive service; (2) pay up to four employees, in addition to the Executive Director, at senior executive pay rates; and (3) rent office space in the District of Columbia or its environs.

Fair Sentencing Act of 2009 - Amends the Controlled Substances Act and the Controlled Substances Import and Export Act to: (1) increase the amount of a controlled substance or mixture containing a cocaine base (i.e., crack cocaine) required for the imposition of mandatory minimum prison terms for crack cocaine trafficking to eliminate the sentencing disparity between crack and powder cocaine; (2) increase monetary penalties for drug trafficking and for the importation and exportation of controlled substances. Eliminates the five-year mandatory minimum prison term for first-time possession of crack cocaine. Directs the U.S. Sentencing Commission to review and amend, if appropriate, its sentencing guidelines for trafficking in a controlled substance to reflect the use of a dangerous weapon or violence in such crime and the culpability and the role of the defendant in such crime, taking into account certain aggravating and mitigating factors. Directs the Comptroller General to report on the effectiveness of drug court programs funded by the Department of Justice (DOJ) Office of Justice Programs.

Ryan White HIV/AIDS Treatment Extension Act of 2009 - Amends provisions of title XXVI of the Public Health Service Act (popularly known as the Ryan White Care Act [RWCA]) to extend and reauthorize appropriations for the RWCA. Extends the transition period for reporting living names-based non-AIDS cases of HIV. Sets forth provisions governing eligible metropolitan areas (EMAs) being considered transitional areas for purposes of emergency relief grants. Limits the maximum amount that a grant to an EMA or a state may decrease from the prior fiscal year. Requires the HIV health services planning council to develop a strategy for identifying individuals with HIV/AIDS who are unaware of their HIV status. Adjusts the number of living cases of HIV/AIDS for areas that moved to names-based reporting systems in FY2007. Increases from 2% to 5% the percentage of unobligated balances permitted from the prior fiscal year for purposes of eligibility for supplemental grants and avoidance of grant reductions. Requires state applications for Care grants (grants to enable states to improve health care and support services for individuals and families with HIV/AIDS) to include a plan related to identifying and making services available to individuals with HIV/AIDS who are not aware of their status. Sets forth provisions related to rebates under the AIDS Drug Assistance Program, including excluding certain rebate amounts from unobligated balances. Requires the Secretary of Health and Human Services (HHS) to establish a national HIV/AIDS testing goal of 5 million tests annually through federally supported HIV/AIDS prevention, treatment, and care programs. Sets forth provisions governing notification of emergency response employees of their exposure to infectious diseases.

Extends through calendar 2012 the commercial space transportation liability regime (under which the United States shall pay up to $1.5 billion, adjusted for inflation, in excess of the amount covered by liability insurance or demonstrated financial responsibility with respect to a third party claim against a commercial space launch or reentry licensee, transferee, contractor, subcontractor, or customer for death, bodily injury, or property damage or loss resulting from an activity carried out under the license). Extends this guarantee to issued or transferred licenses for which the Secretary of Transportation receives a complete and valid application by December 31, 2012 (currently, by December 31, 2009).

Federal Judiciary Administrative Improvements Act of 2009 - Amends the federal judicial code to: (1) remove the power of certain active or retired federal judges to appoint U.S. magistrate judges; (2) revise the statutory description of the District of North Dakota to eliminate the current four divisions each of which holds court exclusively for specified counties; (3) revise requirements for the disability retirement and cost-of-living adjustments of annuities for territorial judges; and (4) revise requirements for the compensation of Federal Judicial Center personnel, including reemployed annuitants. Amends federal civil service law to subject judicial branch senior executives to federal civil service annual leave requirements and limitations. Amends the federal criminal code to: (1) require court use of separate judgment and statement of reasons forms in the imposition of a criminal sentence; (2) require appropriate adaptation of pretrial services functions for juveniles; (3) modify the reporting schedule for criminal wiretap orders; and (4) increase the compensation thresholds triggering administrative review of compensation for non-counsel investigative, expert, or other services necessary for adequate representation of a person financially unable to obtain them.

Amends title XVIII (Medicare) of the Social Security Act to postpone until January 1, 2010, the effective date of the requirement that pharmacies, as suppliers of Medicare items and services (including durable medical equipment [DME]), must be accredited by an independent accreditation organization approved by the Secretary of Health and Human Services (HHS). Declares that nothing in this Act shall be construed to affect the application of an accreditation requirement for pharmacies to qualify for bidding in a competitive acquisition area.

Enhanced Partnership with Pakistan Act of 2009 - Specifies principles that Congress declares should be the basis of the relationship between the United States and Pakistan. Authorizes the President to provide assistance to Pakistan to support: (1) democratic institutions; (2) efforts to expand rule of law, build the capacity, transparency, and trust in government institutions, and promote internationally recognized human rights; (3) economic freedom and development; (4) investments in people, particularly women and children; and (5) strengthen public diplomacy to combat militant extremism and promote a better understanding of the United States. Authorizes FY2010-FY2014 appropriations for assistance to Pakistan under the Foreign Assistance Act of 1961, including: (1) international military education and training (IMET); and (2) foreign military financing for the purchase of defense articles and services, among other things. Authorizes the Secretary of State to establish an exchange program between military and civilian personnel of Pakistan and certain other countries, including North Atlantic Treaty Organization (NATO) member countries. Prohibits any security-related assistance and arms transfers to Pakistan during FY2010-FY2014 until the Secretary of State certifies that: (1) Pakistan's government is continuing to cooperate with the United States in efforts to dismantle supplier networks relating to the acquisition of nuclear weapons-related materials; (2) Pakistan's government during the preceding fiscal year has demonstrated a sustained commitment to and is making significant efforts towards combating terrorist groups; and (3) Pakistan's security forces are not materially and substantially subverting Pakistan's political or judicial processes. Provides for a national security waiver of such limits. Prescribes FY2010 requirements for the Department of State's Pakistan Counterinsurgency Capability Fund. Restricts the provision of any direct cash security-related U.S. assistance or non-assistance payments to Pakistan to civilian authorities of a civilian government. Provides for a national security waiver of such restriction. Directs the Secretary to submit a Pakistan Assistance Strategy Report to the appropriate congressional committees. Requires the Comptroller General to review and comment on the Report, and recommend any additional actions that could help improve the efficiency and effectiveness of U.S. efforts to meet the objectives of this Act. Directs the President to develop and report to the appropriate congressional committees on a comprehensive interagency regional security strategy to eliminate terrorist threats and close safe havens in Pakistan.
