Drug Cartel Terrorist Designation Act This bill directs the Department of State to designate four specified drug cartels as foreign terrorist organizations. (Among other things, such a designation allows the Department of the Treasury to require U.S. financial institutions to block transactions involving the organization.) The four specified cartels in the bill are the Gulf Cartel, the Cartel Del Noreste, the Cartel de Sinaloa, and the Cartel de Jalisco Nueva Generacion. The bill also requires the State Department to submit a detailed report on those four cartels and any other cartels it may identify. Based on this report, the State Department must designate as a foreign terrorist organization any such identified cartel (or faction thereof) that meets certain criteria for designation as a foreign terrorist organization. The bill specifies that it may not be construed to expand eligibility for asylum.

Stop the Cartels Act This bill addresses various issues relating to immigration, law enforcement cooperation with Mexico, and drug cartels. The bill bars federal financial assistance for state or local jurisdictions that (1) restrict compliance with immigration detainers issued by the Department of Homeland Security, or (2) have any law or policy that violates immigration laws. Furthermore, under this bill, the detention of alien minors must be governed by specified sections of the Immigration and Nationality Act and not any judicial decree or settlement. (A 1997 settlement agreement imposes requirements related to the treatment of such minors, including limits on how long they may be detained under certain conditions.) The bill also makes various changes to asylum applications, including by (1) increasing the burden that an asylum applicant must meet to establish a credible fear of persecution, and (2) establishing refugee application and processing centers in Central America. In addition, certain Department of State and U.S. Agency for International Development assistance may not be made available to Mexico's government until the State Department certifies that Mexico has removed certain barriers to law enforcement cooperation and intelligence sharing between the United States and Mexico. The bill also establishes the foreign Special Transnational Criminal Organization designation and establishes penalties related to designated organizations, such as making it a crime to knowingly provide material support to such an organization. The State Department must designate specified organizations, including the Sinaloa Cartel, with the designation, and may designate other organizations that fit the bill's criteria.

Deport Alien Gang Members Act This bill makes non-U.S. nationals ( aliens under federal law) associated with criminal gangs inadmissible for entry into the United States and deportable. The bill also establishes procedures to designate groups as criminal gangs. An individual shall be inadmissible if certain officers or agencies know or have reason to believe that the individual is or was a criminal gang member or has participated or aided such a group's illegal activities. An individual who is or was a member of such a gang, has participated or aided such a group's illegal activities, or seeks to enter or has entered the United States in furtherance of such activity shall be deportable. Such individuals must be subject to mandatory detention. Furthermore, such individuals shall not be eligible for (1) asylum; (2) temporary protected status; (3) special immigrant juvenile visas; or (4) parole, unless they are assisting the government in a law enforcement matter. The bill defines a criminal gang as a group of five or more persons (1) where one of its primary purposes is committing specified criminal offenses and its members have engaged in a continuing series of such offenses within the past five years, or (2) that has been designated as a criminal gang by the Department of Homeland Security (DHS). The bill also establishes procedures for DHS to designate a group as a criminal gang, including notifying Congress, publishing a notice in the Federal Register, and providing an opportunity for the group to petition for review of the designation.

Securing Migration, Addressing Reform, and Talent Retention Act or the SMART Act This bill modifies the U.S. immigration system, including by eliminating the diversity and employment-based visa systems, establishing a points-based system, and capping other immigration categories. The diversity visa program—which makes visas available to individuals from countries that send fewer immigrants—is eliminated. The bill caps annual refugee admission at 50,000. Currently, the President sets annual limits. The bill limits the current family-sponsored immigration system by lowering the annual cap and narrowing the qualifications by, for example, lowering the age limit of qualifying children and eliminating siblings as a qualifying relationship. The bill also disqualifies noncitizen parents of adult U.S. citizens from this category and creates a new nonimmigrant visa for such parents. This visa has an initial authorization period of five years and may be extended for additional five-year periods. The bill also eliminates the employment-based visa system and replaces it with a points-based system. Points are awarded on the basis of characteristics such as age, education, English proficiency, the salary of prospective employment, investment in and management of a new commercial enterprise, and number of dependent children. Visas are awarded to the applicants with the most points (and their immediate family members) until the annual cap is reached. The bill also revises the H-1B visa program to award visas in order of compensation rate. The bill also creates a visa for immigrants who invest at least $5 million into a new commercial enterprise.
