Clean Power Plant Act of 2001

Clean Power Plant Act of 2001 - Amends the Clean Air Act to require specified emissions limitations on mercury, sulfur dioxide, and nitrogen oxides (NOx) from fossil fuel-fired electric generating units with a nameplate capacity of at least 15 megawatts that use a combustion device primarily to generate electricity for sale. Requires quarterly pollutant-specific emission reports for such pollutants and for carbon dioxide (CO2) by unit owners or operators. Directs the Administrator of the Environmental Protection Agency to publish facility-specific emission data. Requires regulations for disclosure of data concerning emissions levels. Directs the Administrator to calculate a generation performance standard for CO2 from covered fossil fuel-fired electric generating units and allocate allowances among such units. Authorizes the carryover and trading of unused allowances and requires surrender to the Administrator of a number of CO2 allowances equal to the total tonnage emitted during the calendar year. Permits the performance standard to be exceeded if the plant has sufficient emissions credits. Imposes an excess emissions penalty and requires units to offset such emissions. Requires regulations concerning transfer of hazards associated with combustion from one medium to another and release of hazardous wastes into the environment. Expresses the sense of Congress concerning crediting permanent CO2 and NOx emissions reductions to the utility sector in any enacted climate change implementation program. Authorizes appropriations for industry and community assistance and development of a carbon sequestration strategy. Requires grants to municipalities in which there are located fossil fuel-fired electric generating units that: (1) provide ten percent or more of the municipality's annual property tax revenue in the last fiscal year ending before this Act's enactment; and (2) cease operation after this Act's enactment. Includes hazardous air pollutants from electric utility steam generating units on a list of such pollutants from major and area sources required under the Clean Air Act.

Sets forth additional compliance requirements for outdated powerplants.

Electricity Emergency Relief Act

Electricity Emergency Relief Act - Directs the Federal Energy Regulatory Commission (FERC) to: (1) establish a clearinghouse system to facilitate agreements between wholesale sellers of electric energy and wholesale purchasers willing to forego temporarily electric energy purchases to which they are entitled; (2) implement a program that authorizes any electric consumer of any electric utility within the Western Systems to sell at market prices an amount of electric load the consumer is willing to forego; (3) study electric power transmission congestion jointly with the Secretary of Energy; and (4) develop a plan to relieve constraints that reduce the efficiency of electric power transmission, including Canadian and Mexican electric transmission systems. Authorizes the Administrator of the Western Area Power Administration System to expand its transmission system to remove the PATH 15 constraint. Establishes an Office of Tribal Energy within the Department of Energy. Sets guidelines for either a qualifying small power production facility or cogeneration facility suspension of electric energy due to nonpayment. Instructs FERC to promulgate a standard article to permit increased generation at licensed hydroelectric facilities. Permits, upon request of certain State Governors: (1) the Administrator of the Bonneville Power Administration to authorize maximized electric generation at hydropower facilities providing power to the Administration; (2) the Administrator of the Environmental Protection Agency to waive Clean Air Act requirements pertaining to oxides of nitrogen for new generation units; and (3) the Secretary to authorize a qualified Federal electric generation facility to generate electric energy for consumption or for sales for local State distribution. Authorizes a State Governor, on any high electricity emergency day, to waive Clean Air Act emission limitations. Provides for a regional transmission organization for the region covered by the Western Systems Coordinating Council.

Clean Smokestacks Act of 2001 - Amends the Clean Air Act (CAA) to require the Administrator of the Environmental Protection Agency to promulgate regulations to achieve specified reductions in emissions of sulfur dioxide, nitrogen oxide, carbon dioxide, and mercury from powerplants (electric generation facilities with a nameplate capacity of 15 megawatts or more that use a combustion device to generate electricity for sale) by January 1, 2007. Requires powerplants, on the later of the date 30 years after the powerplant commenced operation or five years after this Act's enactment, to comply with the most recent new source performance standards under CAA provisions regarding air quality and emissions limitations and with specified requirements for modified sources.

Makes it unlawful, after January 1, 2002, for: (1) the owner or operator of an affected facility to emit nitrogen oxides exceeding the amount of allowances held; or (2) any person to hold, use, or transfer such allowances, except as provided under this Act. Repeals the nitrogen oxides emission reduction program under the Clean Air Act. Imposes penalties for emissions in excess of allowances. Requires offsets of allowances in the calendar year following the one in which excess emissions occurred. Decreases the amount of sulfur dioxide authorized to be emitted under an existing allowance program for 2007 and subsequent years. Provides for regulations to: (1) protect specified regional ecosystems, including those modifying nitrogen oxide and sulfur dioxide allowance allocations; and (2) control electric utility and industrial source mercury emissions. Directs the Administrator to establish a competitive grant program to fund research related to the effects of nitrogen deposition on sensitive watersheds and coastal estuaries in the eastern United States.

Clean Power Plant and Modernization Act of 2001 - Requires fossil fuel-fired generating units that commence operation before ten years after this Act's enactment to achieve and maintain a specified combustion heat rate efficiency. Authorizes waivers for units that commence operation more than ten years after enactment. Requires units, not later than ten years after enactment, to operate in compliance with new source review requirements under the Clean Air Act. Establishes specified emission limitations for mercury, carbon dioxide, sulfur dioxide, and nitrogen oxides from units based on the respective efficiency standards. Requires units to obtain permits under such Act that require compliance with such standards and limitations. Directs the Administrator of the Environmental Protection Agency to promulgate: (1) fuel sampling and emission monitoring techniques for use in calculating mercury emission reductions; and (2) regulations concerning disclosure to consumers of unit emissions levels and the transfer of captured or recovered mercury. Qualifies certain solar or geothermal power facilities for the renewable energy tax credit and extends the date by which eligible facilities must have been placed in service. Imposes an excise tax on covered fossil fuel-fired generating units based upon megawatt hour generation to fund the Clean Air Trust Fund established by this Act. Provides for: (1) accelerated depreciation and cost recovery for certain investor-owned units; and (2) annual grants for capital expenditures for new publicly owned units in amounts equal to the depreciation deduction that would be realized by similarly situated investor-owned units. Expresses the sense of Congress with respect to crediting permanent reductions in carbon dioxide and nitrogen oxide emissions to the utility sector and owners or operators in any climate change implementation program enacted by Congress and passing on accrued value to utility customers. Directs the Secretary of Energy to: (1) fund programs and partnerships to demonstrate the commercial viability and environmental benefits of power generation from biomass, geothermal, solar, and wind technologies and from fuel cells; and (2) establish a program to demonstrate the benefits of power generation from clean coal, advanced gas turbine, and combined heat and power technologies. Provides assistance for coal industry and community transition, carbon sequestration activities, and atmospheric monitoring programs.
