Summary

Simplification and acceleration of land-use planning and spatial planning: complete digitalization of land-use planning procedures, streamlining of the environmental assessment and introduction of binding procedural deadlines and a preclusion requirement, waiver of mandatory early public participation, simplification of the admissibility of projects through land-use plans and introduction of partial land-use plans, upgrading of the land-use plan for outdoor areas, authorization basis for the establishment of municipal restoration statutes to maintain and increase the proportion of green spaces and tree canopy, among others; recognition of housing as an overriding public interest; Mission statement of threefold internal development; Strengthening urban planning instruments for climate adaptation, especially for dealing with flooding caused by floods or heavy rain events; Measures to strengthen the public interest, such as protecting pre-emption rights against circumvention and a package of measures for dealing with junk properties; Restriction of fundamental rights regarding the inviolability of the home;<br /> Change number §§ Building Code and Spatial Planning Act as well as Building Use Ordinance and Planning Symbols Ordinance, changes to a further 5 laws and 3 legal ordinances; Authorization to issue regulations<br /> <br /> Reference: Agreement in the coalition agreement to accelerate planning and approval procedures<br /> Regulation (EU) 2024/1991 of 24 June 2024 on the restoration of nature and amending Regulation (EU) 2022/869 (OJ L 2024/1991, July 29, 2024)
